When to apply for a SS Card?

Hello All,

My wife recently entered on a K-1 and we married in November. We've sent off her AOS packet and are now waiting for approval. Can she apply for a social security card now, or do we have to wait until she receives permanent resident status? I know this must be a common question, but I've been unable to locate an answer.

Your wife should have applied for her SSN 2 weeks after her arrival in the US..... if she has now been in the US for more than 76 days then she will have to wait until she has either a EAD or her Greencard before she can apply for her SSN....

K-1 can only apply for SSN within 76 days of entry to the USA, after that you will need EAD or green-card to apply for SSN.

K-1 is "Work Auth" primarily to be able to get the SSN, some states are strict in their interpretation of a federal law that requires persons applying for a "license" to have SSN, this can cause a problem with marriage license if only one person has SSN and the other (the K-1 holder) does not. So if trying to get SSN after marriage using only the K-1 and marriage cert, you may run into some resistance at the SSA office.

An issue I am starting to hear about from other K-1 into AOS applicants that already have the EAD is that USCIS is apparently not updating names so that SSA can issue a number in the "normal" time frame. SSA tells people to wait a little longer before receiving their number, to the tune of 4-6 weeks. Has anyone come across this??

Is the 76 day rule true for K3 visa holders too?

No, K-3 status holders are not work authorized until they file an I-765 application and are approved, this is very different than K-1 status holders who are work authorized for the first 90 days after arrival into the US.

An issue I am starting to hear about from other K-1 into AOS applicants that already have the EAD is that USCIS is apparently not updating names so that SSA can issue a number in the "normal" time frame. SSA tells people to wait a little longer before receiving their number, to the tune of 4-6 weeks. Has anyone come across this??

Just got back from the SS office. I already had a # because of previous work in to US but needed to change my name. I had my EAD in my new name. They took my old card and told me to wait 6-8 weeks for them to verify the doc. I told them that I was about to start a new job and they gave me a letter to show my employer that I applied for a card and I am good to work while I wait for the card, to answer you long wait question.

Just wondering did they tell you you had to give them the old card or just just asked for it and you handed it over?
