ST. PAUL, Minn. - In an effort to help Sen. Larry Craig, the American Civil Liberties Union is arguing that people who have sex in public bathrooms have an expectation of privacy.

The ACLU filed a brief Tuesday supporting Craig. It cited a Minnesota Supreme Court ruling 38 years ago that found that people who have sex in closed stalls in public restrooms "have a reasonable expectation of privacy."

That means the state cannot prove Craig was inviting an undercover officer to have sex in public, the ACLU wrote.

The ACLU argued that even if Craig was inviting the officer to have sex, his actions wouldn't be illegal.

"The government cannot prove beyond a reasonable doubt that Senator Craig was inviting the undercover officer to engage in anything other than sexual intimacy that would not have called attention to itself in a closed stall in the public restroom," the ACLU wrote in its brief.

Not really. They just have a different read of the 2nd Amendment than you do.

We believe that the constitutional right to bear arms is primarily a collective one, intended mainly to protect the right of the states to maintain militias to assure their own freedom and security against the central government ... The ACLU therefore believes that the Second Amendment does not confer an unlimited right upon individuals to own guns or other weapons nor does it prohibit reasonable regulation of gun ownership, such as licensing and registration.

There is no privacy in a public restroom. The illusion of it, true, but in practice, you can hear everything and well. There will always be the dumb kids that think it is funny to peak under your stall just to see what is happening, bad locks and people just barge in. If you want privacy the public pisshole ain't it. This is one of the stupider things I have read this morning.

How can there be privacy when there is a one-half to one inch gap on both sides of the door that doesn't even require looking under the door to see what's going on...???? :wacko:

That's what I like about British loos...that so many of them are completely enclosed so that you really DO get privacy.....maybe THAT'S why so many British bathrooms have condom dispensers in them....hmmmmmmm

No door, lol. I've seen that once.

I've seen it more than once. A lot of UK nightclubs do that to dissuade people from doing drugs in the bathrooms.

How can there be privacy when there is a one-half to one inch gap on both sides of the door that doesn't even require looking under the door to see what's going on...???? :wacko:

I'm with George Constanza on that - the restroom doors should go all the way to the floor.

I'm with George Constanza on that - the restroom doors should go all the way to the floor.

I'd settle for my feet peeking out if I could get doors that didn't have gaps around them...

Hazards of having girlie bits, I guess. Kids are far more likely to be dragged into the women's restroom than men's.

There's no "right to privacy" in a public restroom, period. You may have the expectation to urinate or deficate without being harassed, but privacy? It's not your restroom or the person's next to you either. It belongs to the establishment you're in and they may decide how much or how little privacy people who use it have. If you dislike that, then use the restroom elsewhere.

As for a "right to privacy while having sex in a public restroom"... well, that's ludicrous. Restrooms are for excreting waste; not for copulation. I don't even understand why anyone would want to have sex in a public restroom -- in most, I'm more than happy to leave as soon as possible (especially if using a stall), so I can't imagine choosing to perform a sexual act in one.
