I finally broke down and called CSC using the RFE trick. Surprisingly, the guy I spoke with was very courteous and took time to answer all my questions.

According to the rep, CSC is currently processing I-129F(K3) petitions with a receipt date of July 30,2007 or earlier. Also, he stated that they go by the NOA1 notice date and not the "Received Date" as a few people on the forum have suggested.

Our NOA1 is August 30, so I guess we have at least another month before we get our approval. If I wasn't traveling to see my wife next week, I would be seriously bummed.

Yes, my husband just called CSC as well, (using the RFE trick) and this is what he emailed me a while ago:

"I talked to an Officer Ellis at USCIS and he was very nice and helpful. Not rushing me in any way and looked into each of our cases. Unfortunately our 2 files have not been assigned an officer yet but he said that it should be worked on within a couple weeks.

Today they are working on July 27th I-130 files (I realize this is our date) and some files w/ prior dates. He also said they are at July 30th files for the I-129F submittals."

Hello there,

I think you were given the wrong information. When I called I was told they go by the received date (priority date). The priority date is what shows on your approval. My I-130 was received at USCIS on May 24th and this is the date they honored. The notice date is July 11th (or 12th...can't remember). So like I said, they go by the date they receive it...they do honor that. Even though some USCIS reps will tell you they go by the notice date.

CG, this is not something that a few members have pulled out of thin air, it is actually USCISs official statement on their website and it clearly says that they honour the received date.

Date Received in Mailroom – USCIS will honor the actual date that an application was received in our mailroom; this date will be indicated on the receipt (in the Received Date box) when Form I-797, Notice of Action, is mailed. You can see a sample Form I-797 under "Related Links" on this page. If your case is affected by the receipt delay, arrival of your receipt may take up to 12 weeks for adjustment-of-status applications and 15 weeks for naturalization and other applications.

If the customer service rep is correct, then USCIS are not following their own posted procedures :wacko: Either that, or they haven't reached the petitions that they deem "delayed enough" to apply it too :wacko:

Well, I hope this guy was wrong and that they are truly honoring the Received Date. Our Received date is 7/30 and our NOA1 date is 8/30.

You are welcome!!!! But keep in mind that the word "HONOR" may not mean a lot to the USCIS people (you are right GOGO).

But rest assured that they go by the received date....like C and J mentioned.

Thank you very much! I really don't know how much longer I can hold for this.. :crying: :crying: I always say a prayer every night (and so does she).. when I told her yesterday about what I say for my prayer everyday, I just started to cry right away.. which made her cry too.. Anyway, just pay attention to when VJers around your receipt date are getting approved. This method seems to be the most accurate. :thumbs:

The receipt date is not the notice date- this may well be true for NOA2 but really that's irrelevant since the NOA2 means the end to dealing with USCIS (for a particular petition). Many people receive their NOA1 months after their application was received. VJers have been posting their notice date in the NOA1 box because that is what VJ instructs them to do. VJ bases timeline data on the "sent date" and NOA2 date because it recognises the actual length of time the petition has been with USCIS before approval.
