Timeline

HI All..

Happy New Year... I have two questions

1) my ex- husband is from tunisia/north africa.. we were married for 5 years before divorcing.. he recieved his green card through are marriage.. would this make any difference for my new fiance who is morrocan descent living in italy?

2) it seems the normal process for the k-1 visa is 4-6 months.. ( i spoke with a friend of mine's husband who told me that the whole process takes 6 months) is this optomistic of me to think just 4-6 months..

Hi there- I don't know much about the previous marriage thing. However, the current processing time to get an NO2A is about 4-6 months. Difficult to say how that time frame window will change in a couple months. Now that is just to get the NO2A approval. After you approved, it is sent to the NVC, then to your fiance's embassy. You will need to look at similar immi timelines for that country and how long that process will take. Good Luck.

11/08/2011 - Interview date THANKS GOD went smooth n pretty easy with the nice lady IO takes 9-10 minutes wow???????????????

I think I waited more time for my Oath Ceremony schedule rather than interview process and after 13 minutes the lady gave my sched WOW CAN'T BELIEVE ......yayyyyyyy

Hi,

As for your first question, I don't think that you're previous marriage will be an obstacle in your current/upcoming K1 process. However, it might raise a red flag, which I however, can be overcome if you have plenty of evidence of a bona fide relationship with your fiance.

Question 2: I think you should expect the entire process to take more than six months (from the time you send in the petition until the visa is received). I don't want to put a damper on your expectations, but 6 months+ is more realistic.

I wish the entire process would only take 4-6 months, and for some people here on the forum it does, but I'm rather pleasantly surprised than terribly disappointed.

The current average time from filing to interview is 209 days, about 7 months. There are many variables that will affect this, such as what consulate you're going through, what service center you're filing through, and how fast you're able to make it through name check at the Department of State. Take a look at the timelines of other Tunisia filers to try to get a better idea of what to expect. Best of luck to you!

Did you file also file a K1 for your ex-husband? They may just ask extra questions as to your former marriage but probably won't even come up. You could always attach a note of explanation to your forms if you feel it's necessary. Especially if you aren't able to be at the interview. One thing to keep in mind if your ex-husband got his green card through your marriage that means at one time you filed an affidavit of support for him. Which means your responsibilities to him don't end until he is a citizen or has worked to earn enough credits with social security (about 10 years). Your responsibility to him as a sponsor to his residency does not end with divorce. This just means that when you calculate your income requirements for your present fiance you will need to include your ex husband in the family size. On the second question, my fiance is Albanian and we reside in Italy. Ours took the full 6 months from NOA1 till NOA2 approval. It kind of seems like cases get lumped together though cause I've seen other cases approved at the same time as ours but submitted later than ours was. But it might also depend on which service center is processing. It seems though that they aim to complete the cases within 6 months. It does take a little bit of time to prepare the next steps and get the interview scheduled.
