We have talked on this before, are you SURE and do you know that your case is back? Look on your noa2 and find the validity date says xxx-xxx, these are issued for 4 months, mine arrived back in Calif the same month it was to expire. I then had my rep to get in touch (after i gave it a few months) i think Oct and i had heard nothing. My rep then got a email telling us the case had expired, no futher action and we were free to refile of course paying the fee again. I then called and ask for a closure letter/denial letter, and was told it was not denied but expired. I forgot if yours would go to calif or not, Vermont is just now touching some that were returned over 18 months ago apparently they may choose to review where Calif is known not to

also i looked again and in that second paragraph after the (USCIS) ours said FOR REVIEW

My understanding is if they send it back and it's a K1, they are no longer reaffirming. They just let them expire and you have to start all over. The best thing you can do Salshi is get your fiancee on this forum and have her get in touch with people in the Returned Petitions thread.

Brnid: Were you able to find out why your petition was returned so you could address it in your new petition? Or is one always to assume the broad 'invalid relationship'?

I am curious as well, how your fiance got his 2nd interview just 4 months after the 1st one. Also, if his 221G stated that the petition would be returned to USCIS for review, how did you manage to get them to change their minds? My fiance had his interview with the older blonde lady on August 3, 2007, and he got the 221G too. We had a huge file of evidence, and after the interview, I also took a very proactive role in trying to get them to reconsider. We actually had a Senator, a Congressman, my Parents, and a friend fax letters. I also emailed them. Everytime they were very nice and apologetic to us, but remained firm in their decision to return. I actually got a letter in the mail (weird, I know!) from the Vice Consul herself in Casaclanca back in late October 2007, saying that they had returned it, and please let her know if there's any more help I need! :no:

We filed in March 2007, interviewed in August 2007, and the case didn't get sent back until October 2007. I don't know why it took them 2 1/2 months to return our petition, but they also told us it was in "AP" when I called DOS. There are different kinds of AP, and some are for security checks before visa issuance, whereas others are for the review and the final signature that is required from the Chief Consul before a petition can be returned. The Consular Officer makes a recommendation to return if you get denied, but it isn't officially ready to be sent back until the Chief CO signs off on it. That's also considered "AP". You are right; They do give a lot of misinformation. We were told our petition went back in August 2007 at first, but didn't go back until October 2007. Also, USCIS told us in November 2007 that it had been reviewed and re-affirmed on November 15, but then they came back and said it's still "pending"! USCIS can be unorganized, and unfortunately there is no single standard protocol that all the service centers adhere to collectively, in terms of denied petitions. I'm scheduled to leave for Morocco by January 28, and we are still waiting to see if they'll close our petition or if it really was re-affirmed (which would be a freak occurance knowing CSC!), so we can be free to marry over there and then re-file the CR1.

Did CSC send you notice when they said the petition was expired? Ours expired in September 2007, while it was still in Casablanca. I contacted the Senator 2 weeks ago in hopes they can at least give us some indication if it they will close it, re-affirm, or just chalk it up as expired. Also, I would like to know if your fiance (now husband....congratulations!), had to go to the Ministry of Foreign Affaires with you in Rabat, for you to have the marriage papers validated? I really need to know that because if we decide to go ahead and get married in Morocco, Driss is working really far away from Rabat (Western Sahara), and it would be hard for him to go there, and all the way back, unless its absolutely necessary. How long did the entire process take, and where did you go for the medical? Email or catch me in yahoo tonight.
