Ok, just to make sure I understand what has been said on recent posts here lately-

If my fiance arrives through JFK and gets his temp EAD, then comes to Indy and we get married the next day...then his temp EAD is invalid and he can't work until he gets his I-765 EAD approval.

Is that correct? Has anyone on here ever kept working on their 90 day EAD even after they got married?

Sept 26- mailed I129F from the UK

Oct 04- NSC receives Petition

Oct 7- Check cashed, we're in the system!

Oct 12- NOA1 receivedl

Oct 21- NOA2 RECEIVED! (email)!! yeah baby, yeah!!!!

Oct 25 NSC ships application to NVC...really rolling now...

Nov 4- NVC ships case to Dublin!!

Nov. 24- Packet 3 received

Dec. 8- Packet 3 materials mailed to Embassy

Dec. 13- Medical in Cork

January 27, 2006- The Interview- SUCCESS!

Feb. 7- He arrived in America- welcome home sweetie!!

Feb. 8- legally married at the Indianapolis clerk's office

Feb. 25- Mailed AOS, EAD, and AP to Chicago lockbox (packet weighed 2.6 pounds!), rec'd Feb. 27

Mar. 6- Received NOAs for I485 and I765, rejection for I131 (incorrect payment). I485 has wrong A#.

Mar. 7- Resubmitted I131

Mar. 14- NOA for I131

April 1, 2006- our Wedding with family and friends in Michigan!!

April 14- Biometrics appointment in Indianapolis

April 25- received Advance Parole

June 19- AOS interview, Indianapolis--APPROVED

June 30- GREEN CARD ARRIVES!!!

No, that is not correct. The temp EAD allows you to work for the full 90 days. But you cannot continue to work after its expiry. You must have the actual EAD to continue working.

I've heard both interpretations -- it seems to be an area not well defined. In any case, I've not heard of anyone being given trouble if they work through the full 90 days, as long as they either stop working at this point or their 1-yr EAD arrives, before the temp EAD expires.

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

It does seem to be something of a grey area. Some deem it invalid once you're not in K1 status (ie. once you get married), others believe it's ok to work the 90 days. I can see it both ways.

Make sure you're wearing clean knickers. You never know when you'll be run over by a bus.
