Filing both 130 and 129F together

Timeline

I plan on filing both forms within the next day or two - I JUST GOT MARRIED to my lovely wife in India. I'm back in the USA now and trying not to waste a minute.

I was going to send both forms to Vermont since I'm in NJ ... I was hoping I could get by the "standalone 130" deal by using the fact that both forms are going in one envelope - but the processing would be 'standalone' nonetheless ... since these are treated as two separate petitions ..

Am I just wasting time by sending it to VT directly (only to have it sent to the lockbox to wait anyway) ???? I wanted to avoid the lockbox mess because God only knows how long it'll take to get to them unless it's sent straight to the VSC...

Someone please advise...

I-751 Process -

5/24/10 : I-751 Packet sent to VSC

5/26/10 : Delivered to SAINT ALBANS VT 05479 @ 11:46am

5/27/10 : NOA1 Date (based on scanned check image)

5/28/10 : Funds withdrawn from bank account

6/04/10 : NOA1 (I-797) received, confirming above NOA1 receipt date.

7/31/10 : Biometrics letter received - Appointment date of 8/11/10!

8/11/10 : Biometrics done!

8/29/10 : GC received (sometime last week lol)! (WOW!)

Previous timeline of our Busy 2008!!

1/06 : Married my JAAN :)

1/15 : I-130 and I-129F sent to Chicago Lockbox

1/17 : Both petitions received @ Chicago

2/27 : Check cashed & I-130 petition visible on system.

2/29 : Received NOA1's! Notice Date - 2/22/08

5/01 : I-130 APPROVED!!! (But not my I-129F)

5/08 : Got Case # from NVC (received 5/7/08)

5/11 : PAID AOS Fee Online -- I-129F still pending; full speed ahead with I-130!

5/12 : Neetu emailed NVC re: DS-3032 (choice of agent)

5/13 : AOS Status now "PAID" -- AOS PRIORITY MAILED

5/16 : NVC received AOS

5/19 : DS-3032 email accepted & AOS entered in system

5/24 : IV Bill Invoiced and paid online

5/28 : IV Bill status = PAID -- DS-230 EXPRESS MAILED!

5/29 : NVC received DS-230 at 11:01 am

5/30 : DS-230 entered into system

6/03 : CASE COMPLETE - 26 DAYS AFTER NVC RECEIVED I-130

6/10 : Interview scheduled (for 7/9 originally)

6/14 : Interview letter (my copy) received.

6/16 & 6/21 : Medical

7/16 : Interview completed - APPROVED!

7/21 : Neetu picked up passport/brown packet from VFS

7/25 : POE AT EWR!!!

End of Sept: GC received!

Send straight to VSC, let them send your I130 to lockbox. There is no getting around the lock box, but at least if you file them together you won't have to wait 4 months for an NOA1

When filing together, make sure to keep each packet separate. I would recommend placing each packet in its own envelope or folder with its own cover letter. Then place both envelopes together in your mailing package. It would be wise to include a separate cover letter that explains that you are filing the packets together. Look in the link in my signature to see how I packaged them. Please keep in mind that the fees have changed since I sent my packets.

8/28/2007 - NOA-1 date - CSC

3/19/2008 - NOA2 date -CSC

I-130 held by USCIS for future AOS

7/27/2007 - Sent I-129F Package to TSC*

7/30/2007 - Received by TSC

8/30/2007 - NOA-1 - Fee waived

3/19/2008 - NOA2

4/3/2008 - Received by NVC

4/10/2008 - Received by embassy

4/11/2008 - Faxed packet 3 forms to embassy

4/30/2008 - Appointment date assigned

6/19/2008 - Appointment at Bogota Embassy - APPROVED!!!

No touches except when I called CSC directly to inquire.

8/28/2008 - POE Houston

Still being lazy and waiting to do AOS.

*I-130 and I-129F sent together to TSC per USCIS instructions.

Thanks, I did exactly that :)

I have one cover letter to explain why there are two petitions/packets, and then I have each of them in separate envelopes with their own cover letters contained in each envelope - so that's a total of three cover letters ...

I put all of that in one envelope and mailed it off this evening - should be arriving at the lockbox on Thursday, 1/17/08.

I ended up going with the lockbox because I called CIS and they said that the application would just be forwarded to the right lockbox anyway so I would actually LOSE time by trying to send it straight to the service center.

What happens to your I129f then? Was it supposed to go to the lockbox or the service center? I thought lockbox was just doing i130's? So your i129f still has to get forwarded to service center. If your going for a k3 isn't the i129f the one you want started on first?

What one want's isn't the issue. A primary requirement for filing an I-129F for a spouse is evidence of having filed an I-130. Think it through from that point.

I am in a situation where by I want to send off the I-130 AND the I-129F - where you just stated about needing the NOA1 was where I was getting confused - can I send the two forms together, then, or should I be waiting until I get notification of the I-130?

Im interested in seeing how filing the two forms together worked out for you.
