Please Help: No NAO1 received after 3 months!! Is this normal

Hey everyone,

I hope someone can help me, because I really am desperate!!! :crying:

I am French and I met my boyfriend Jason - who is american citizen - two years and a half ago in Alaska... Since then, we have had a long distance relationship and we have visited each other as often as possible. Jason asked me to marry him last september, and we started the application for the K1 visa. In mid october 2007, all the papers for the I-129F application have been sent to the California Service Center, we have received shortly after the receipt from the post office, and since then, NOTHING!!

Jason was in France visiting me from beginning of November to mid January 2008. He is just back in AK and has checked his mails yesterday: He doesn't have the NOA1?? This means we have no idea what is going on, as we don't have any recipt number...

I read that it takes about 2 to 3 weeks to receive this notification, so I don't understand why it is not there... This is not good at all. Can it take longer that these 3 weeks??? Can it take more than 3 months?? Is there a way to contact the California Service Center??

Can people who sent the I-129F in october tell me if they are in the same case?

Please, I need some help there... All this is killing me.

NOA1 received early March and NOA2 received on March 19th!! We got APPROVED!!

File received by NVC and sent to US Embassy in Paris: 03/10/2008

11/18/10: Sent I-751 to CSV

11/30/10: Receipt notice received in the mail

12/30/10: Called USCIS as no news for 1 month after NOA1

1/10/11: Emailed from USCIS about my call: "The process for fingerprint appointment scheduling has been requested."

1/13/11: NOA2 ASC appointment notice

2/3/11: Biometrics at local office (NOA2 recieved on 2/2/11!!!)

2/16/11: Date of decision: APPROVED

2/24/11: Card in hand

Congratulations and welcome to VJ

I never received NOA1 either, but after 90 days you can call USCIS and they will "help" you, they can give you your case number and while you have them on the line they may be able to confirm your fiance's mailing address...be sure to do this...as you will need the hard copy of NOA2 for AOS. Have they cashed your check? If you paid via personal check you may be able to get your case number off the back the check (it will be 3 letters followed by 10 numbers) (the endorsment on my check was illegible, so this advise was no help to me).

8/23/07 phoned USCIS (told they can't help until after 90 days)

8/23/07 contacted bank to get copy of Cx check...illegable...noc WAC#

tried for weeks to get actual check....not possible, had to wait the 90 days for info from USCIS

10/17/07 Phoned USCIS, got thru (!), got WAC number and NOA1 date!!!!

07/26/07 NOA1 (never recieved hard copy, was promised a copy would be sent)

11/01/07 Ordered copy of "long form" UK B.C.

11/05/07 Recieved B.C. (Wish USCIS was that fast!)

11/09/07 Submitted request for UK police records

12/04/07 APPROVED By USCIS NOA2 letter sent (or so they claim)

12/15/07 Police certificate recieved

12/28/07 Called NVC, not in system

01/04/08 petition forwarded to London

01/12/08 packet 3 received *rubs eye in disbelief* Speed and efficiency, can it be?

01/18/08 HARD COPY OF NOA2 ARRIVED...seems the snail made a wrong turn somewhere.

01/28/08 Returned packet 3 to London Embassy

02/12/08 Medical completed...no problem.

02/13/08 Packet 4 received from London Embassy

03/03/08 Embassy Interview

03/06/08 Visa Arrived....Lovely to finally see it even if it is a bit drab...after 8 month you think they'd have sprung for some gold foil or at least a COLOR photo?

No, this is not "normal'.

You should have received the NOA1 within about 5 to 10 days.

My 129F was overnighted via US Postal Service on October 15th to the California Service Center. I received the NOA1 on October 19th.

You definatley need to place a call to the center.

It may not be normal but there have been loads of inconsistencies lately so don't worry yourself too much. You had delivery conf from the post office and have you Fiance see if the check was cashed, if he can get the case number off the back you can check your status online and if not you can call USCIS.

I would call.

We sent our petition to VSC on December 5th, they got it on the 10th and we got our NOA1 in the mail on the 14th. Our NOA1 date was December 11th.

Has the check been cashed? If it has, he can contact his bank about getting a copy of the scanned check to get your case number from the back of it.

Sometimes people never get an NOA1 but if your check hasn't been cashed either, I think there is probably a problem. CSC is usually way slower than VSC but 3 months is getting a little ridiculous.

Hi everyone,

Thanks a lot for your many answers!!!! That gives me a little hope... :wacko::unsure:

I have managed to reach a person at the Service Center, but as I am not the US citizen, I couldn't go further. My boyfriend is going to call them back today.

Do you know how long exactly they will need to tell us whether our case is processing or whether they have lost it?? I really hope we won't have to send another application.. My fiancé is in the US right now, and I am in France, so it doesn't make things easy.

All this makes me sick.. I am so scared that things aren't going to be ok...

Good luck for all of you anyway! It really is worth all these efforts...

Do you have the cancelled check? You can get your case number off the back of the check. The NO1A is really worthless other than the case number so you can check online status of your case. The NO2A is what is really in demand.

You know... I filed in August, and got a reply in October. They are really backed up right now. But yes, since its been 3 months, they allow you to call them. But keep in mind, that 3 months is not an unheard of number. Its good that you are on top of things though. hurry them along at every chance you get~ goodluck!

Hi again,

Thanks all for your help. I gave all the info to my fiancé, he is now the only one who can obtain the info. I am not sure with what he paid, I think it was a cashier check, so hopefully he will be able to get more info at the bank if the money has been withdrown..

How far are you in the process? I hope it is in better way than mine!!

We even dont have really start at this time.

We are preparing all documents and forms, i let my divorce decree yesterday to a certified translation agency. So we will send the petition in february. I hope all will be fine as its for a K1 and K2. I just asked the family court to have an appointment with the judge to friendly legalize that my daughter's father agree. But i will feel really good only when i will have that judgment in my hands (it can take about 3 months)

So... a lot of hopes and worries...

Ok, so I just have had news from my boyfriend. He called the USCIS, but they told him he should wait 1 to 4 week slonger before getting worried. It can now takes longer than 90 days to get the NOA1 apparently.

However, we now know that the check was cashed the 25th of october. Good news, no?! This means everything is processing, right? Or should I still worry until I really get a proof that they are working on my case?? I just don't get why some october fillers have received the NOA1 so quickly, and why it has taken over 3 months for us and they still tell us to be patient. Do you think this means that october fillers who got it earlier have their case much further than mine, even if they filled at the same time??

I am a bit relieved by the cashed check, but I can't help worrying...

I sent my I-130 packet to the California Service Center on October 8, 2007, and USCIS received it the next day. Just yesterday I received my NOA1. The NOA1 has notice date of January 9, 2007. Exactly 90 days later. You probably might hear something very soon.
