so may 9 2008 will be my wife's 2 year anniversary for the green card. Our lawyer who originally did our paperwork is voluntaring to process our I-751 paperwork for us.

couple of questions:

Once we overnight the paperwork, whats the timeline in getting it approved so they can atleast give my wife the 1 year extension? Reason I ask this is because our Lawyer, although she is great, she does not communicate the process with us.

Her last email to me, she told me that she plans to submit the paperwork "mid feburary." I had intentions of doing it right on Feburary 9th(exactly 90 days before anniversary). Is it okay if we submit our papework after feburary 9th? I emailed her to let her know but I never get her reply.

I want to trust my lawyer, but there is so much lack of communication, it's hard to ask questions and understand the process.

so I ask you guys this: If February 9th is the 90 day before the 2 year anniversary, will we be 'safe' if we submit our papwerwork a few weeks after february 9th? I understand that that the actual process to remove the conditional status takes time, so right now, my main concern is the turnaround time it takes for them to grant the 1 year extension, so my wife will not be illegal in anyway.

second question: we bought a house in 2006. but my mortgage/loan officer did not suggest to add my wife on the loan because I barely qualify for financing. therefore, now, the front page of my mortgage only has my name. However, the deed has my wifes name listed. this wont be a problem will it? I mean, we have other supportrs, but it just so happens that our biggest investment doesnt have her name, because of the suggestion of my loan officer.

P.S, I live in Oklahoma.

We sent our I-751 off 1 month before my wifes card expired, a week or so after the 90 day window opens wont cause any harm. Depending on the Service Center you are using, it generally takes only a few weeks to get your extension letter.

As for your second question...I would send a copy of the deed, don't see how it could really harm you...I'm sure someone will come along that can give you a better answer for that one. :thumbs:

The extension letter is not approval, it is just NOA1 receipt letter, it should arrive a few weeks after filing the I-751.

You do not need to fie exactly on the 90 day mark you can file anytime with in the 90 days, Mid Feb IS a few days after Feb 9. A few weeks or a month or so wont be a problem.

It shouldn't be a problem if your wife's name isn't on the mortgage. Since it is on the deed, that shows joint ownership and counts as evidence that you have co-mingled your assets. My name isn't on either the deed or the mortgage of our home, but we have lots of other evidence of co-mingled assets that I think we will be fine.

My green card expires on may 8, 2008 and i'll be sending my I-751 on feb. 8, 2008 bec. that's the adviced of uscis representative when i called up a week ago.But You can still file during the 90 days immediately this is the instruction from uscis. Abt. the house (mortgage) my name is not included too but my husband will make a will that i am the beneficiary of all his property. don't worrry too much! This site is very helpul if you have query!

We are in the same (house) situation. Hubby had no social security # and for that matter couldn't work, when we bought our house, so they would not add him to the mortgage. I insisted he be on the deed. For the I751 application I submitted our HUD-1 as proof (just as I did for the initial G/C application). I believe the joint ownership is a strong enough proof (without the mortgage).

I have a question: Why would you want to use this lawyer again if she is not a communicating with you? I will only tolerate this type of service if she is doing it for free but if you are paying for her services, she should keep in touch with you and be available when you need her. And if you are paying for her services, she should submitt the paperwork when you tell her to do so. Or you could save money and do it your self. Just my 2 cents.

01.05.08: Response from USCIS received: Required Review still in process. Contacted Congresswoman office.

Approved per Congresswoman's office response given in March 08.

thanks guys. a couple more questions:

what about car title? We were in one of those situations where I financed for a car w/out my wife(in order to qualify), so her name is not listed in the car title either? I also have a bunch of credit cards in which I applied when I was a student, and just never got around to adding her. I do not use the cards anymore, so there is really no need to use it.

things I have so far that has both of our names on it:

Mortgage Deed

car insurance

health insurance

life insurance, her as beneficiary

cell phone bill

started a Roth IRA a few months ago

2006 tax return

2 bank accounts

right now, these are all the major things taht I can think of. I'm actually a bit worried because of the fact that we did not prepare a lot of things up front. It's one of those things where we are thinking "we are a real married couple, we have nothing to hide, so we kind of forgot that we need to provide documentation" type of mindset.
