Lost Passport

Timeline

My husband lost his Jamaican passport last week. I just spoke to the Jamaican consulate who stated they will replace the passport, but not the K-3 Visa.

Does anyone have any idea how the visa gets replaced?

If and when he travels to home country, he will need to get the visa re-issued at the US consulate.

Also if he just remains in the USA and waits for green-card, then you may just have to file an I-102 to get a replacement I-94 card.

this is a super catch-22, he went for a job today and the person wanted to see his passport..even though he had his EAD
The employer is not required to see passport if an EAD card is presented to them.

Thanks for that Info.

I called the US embassy in JA and was told that they do not re-issue K-3 visas. After he gets his new JA passport. We should be able to go down to Immigration and get a stamp in his passport to let him back in the country and from there we put in the AOS package, the lady actually asked me why was he traveling on his k-3, it is a re-entry visa, that is what its there for or maybe its me. Only in JA

But at least now we know.

I don't think USCIS will stamp passport, they do I-551 stamp, but that is for green-card holders, not non-immigrant k-3 holders. Without the K-3 visa he wont be able to re-enter the USA, he needs evidence of status, perhaps an AP document, though this is not normally issued to K-3 holders.

You may have to file form I-539 to "extend" the K-3 visa.

U can't extend what u don't have, once we report it lost it becomes invalid

Wow Jengles that sucks! I don't know what you can do about that. Have you tried contacting USCIS? Maybe a call or and infopass appointment could get you some answers. I really don't know what else to tell you. I sure hope he finds that passport!
