I've read through ALL 107 pages of this NVC forum and I still haven't found my answer so I will post now. The DS-3032 is a simple form designating who will receive the correspondence from the U.S. Dept of State concerning our alien spouse's immigrant visa application. Obviously, if you are not using an immigration attorney, the U.S. Citizen will be the choice of agent 99% of the time.

Here's my situation: I have the pleasure of being able to move to the Philippines to be with my wife and family while we wait for her petition. I will move there before I receive my NOA2 from USCIS...and possibly before the NOA1 at this rate. I currently have USCIS mail being sent to my mother's house (she hasn't actually received anything yet). When NVC generates the AOS Bill and DS-3032, I will be in the Philippines.

Here's my question: I will have the mail from NVC sent to my mother's house. In other words, the address listed on the DS-3032 will be my mother's address. Should I put my mother as choice of agent or should I put myself? Does it even really matter? I guess ultimately, I have confusion because I've not read here of anyone else choosing a choice of agent rather than themselves or their attorney. Can anyone be the choice of agent? I think I know the answer but would like to have confirmation from someone who may more than an assumption.

Thanks,

James

I'm not exactly sure, but our immigration attorney told us (for any type of document from USCIS) to have our names on the mailbox or it would not be delivered to the address we provided. Maybe you could call the NVC customer service to ask them about it.

Well our name isn't on our mailbox and we got all correspondence from NVC, so that seems a bit over the top.

How do you plan on getting the correspondence - is your Mother going to forward the mail to you? If so I would just leave your name and your Mother's address for the agent.

I was told by a USCIS rep to have my name registered to my mother's mail box at the post office and also to put my name on the box. I asked at our post office if I really needed to do that since the federal mail should arrive as 'IN CARE OF' followed by my mother's name. He told me not to worry about it and that it would be delivered. I guess he knows what he's talking about. I'm testing it to see if it works. If I don't receive anything, I guess I'll know why. :) I suppose adjudication of the petition will continue even if I don't receive the mail. No problem until it gets to NVC...but I'll have fixed the problem before then if there is a problem. I'm glad to hear you've had no problem with that, trailmix.

Trailmix, I don't plan on having my mother forward any mail to me since I will have ALL forms and supporting/requested documents prepared to be sent....by my mother. When she gets the NVC notice, she'll just pack up the appropriate forms and documents and send them back. The only thing that she may need to forward is an RFE. And she can just shoot me an email to explain what they need.

I guess the agent is like a black box. Doesn't matter who it is as long as things move! I guess I'll put my name as agent. Thanks for your replies,

James

if i remember correctly, the DS-3032 states that the choice of agent can be the petitioner, another relative, a friend or a charitable organization, such as a church...

it's just most common to choose the USC petitioner as the agent, as i also observed here in VJ

international mail is unreliable and will only delay the petition process, therefore the choice of agent has to be someone residing in the US

NVC strongly recommends that you choose someone with a US address

at least that's what's written in the DS-3032 instructions

my husband is also flying to manila and we are still waiting for my son's I-130 approval

when my son's DS-3032 comes, we will be choosing my USC aunt who is residing in the US as my son's agent

i suppose you can choose your mom as your wife's agent

i don't see anything wrong with that

so long as she has no problem corresponding with NVC and paying the fees for you ;)
