90 days waiting for NOA1 is up Jan 26

Timeline

My 90 days waiting for a NOA-1 on my I-130 will be up Jan 26th. I am wondering I should even bother calling USCIS and if they will even bother putting a trace on my file or just blow me off. It is unnerving thinking that my file has been lost since the get go and I have to sit around and wait months to find out if I need to start over...

10/01/2005: Married in Toronto

02/15/2006: Began Canadian Immigration

09/19/2007: Withdrew CIC application (they still hadn't processed anything)

10/01/2007: Moved back to U.S.

10/26/2007: I-130 mailed to CA Service Center

10/29/2007: USPS confirmation of receipt of I-130

02/13/2008: NOA-1 received (107 days)

07/02/2008: I-130 approved

07/22/2008: AOS filed including EAD and AP

07/25/2008: NOA-1s for all 3 received

08/20/2008: Biometrics appointment

08/22/2008: Received RFE for Affadivit of Support and Medical

10/21/2008: Submitted I-865W in lieu of co-sponsor and medical info to NSC

11/14/2008: online case status not updated since filing of AOS in July 2008

01/20/2009: Received another RFE for Affadavit of Support Info

02/02/2009: Responded to RFE with brand new AOS based on 2008 tax return (if that doesn't shut them up, dunno what will)

02/19/2009: EAD card received in mail (no updates on Online Case Status ever made)

02/23/2009: AP received (again, no online updates)

02/26/2009: Received interview appointment letter for 4/6/09

04/06/2009: AOS approved for unconditional GC

04/21/2009: GC received

I'm not sure what the process is when they haven't sent out the NOA1 - whether they will put a trace on it or not.

I would absolutely give them a call and ask what the heck is going on. Do you know if they have cashed your cheque yet - I'm assuming they haven't which would seem very strange. I haven't been tracking the current NOA1 times - what's the scoop for those who filed in October?

No, they haven't cashed the check yet. I check my bank account daily. The I-130s from July (VSC) and August (CSC) onward were sent to the Chicago Lockbox for initial input a few weeks ago. They are up to Oct 22 per the USCIS receipting delay post at the Chicago Lockbox.

Do you think that means they have completed initial processing of all applications older than Oct 22 or they are just skipping around and that is the latest date they are on?

No I don't think they are skipping around (but it might just be meaningless). I was just looking at the October filers thread and note that many haven't received their NOA1 yet (you mention you have only seen one person).

I would still call - the only pressure they have to get these done is you guys calling. I would be contacting my Senator at this point as well.

I called USCIS and got the blow off. I held for 10 minutes to get the level 1 customer service rep who bombarded me with questions and then who transferred me to a higher level customer service rep who got on the line after a 30 minute hold. Unfortunately, this man had a thick accent and I had difficulty communicating with him. I explained the situation and he said he would do a system search for my name and then after 5 minutes came back and said I wasn't in the system (no duh!). He said to give it another 5 business days and if my check hasn't been cashed, to call back again.

I asked him about the Chicago Lockbox and how it says they are up to Oct 22. He said that date does not mean they have processed everything prior to that date and there very well maybe applications that were received prior to Oct 22 that are still in staging.

If I were able to understand him better, I would of made more inquiries, but since I had to spell my last name for him 4 times (and its not a hard name), I will call and bug some other rep later this week and perhaps get more info.
