two questions! K3 and processing dates

Hey there,

Vermont is already processing the date 19th of March we received our NAO1 for I 129F on March 16th so does that mean that we should get our approval soon???

Another question if I enter the US on the K3 visa...why do I still have to have the I130? Do I need to immigrate in order to live and work in America? What is the actual sense of that? I mean if I can avoid all the expenses to fly back to my home country why would I want to get the CR1? Cant I just become a permanent resident with the K3 when I do the Adjustment of status???

Im confused here.

lol Honey, it's USCIS, NONE of it makes sense!!! Although, the good thing is, if they're processing your date, you should hear from them soon.

6/19/2002- Met Online

11/10/2002- Met in person for the first time at Buffalo International Airport we spend a blissful but all too short week together.

2/23/03- David proposes on the beach in Melbourne Florida at sunrise during his second visit.

9/26/03- After much talk with USCIS we decide to go ahead and get married during David's third visit, with David planning on returning to Ireland the following week.

9/30/03- Phone USCIS to ask questions on filling out paper work and USCIS officer informs us that if David is already here he doesn't need to leave. After numerous calls to the Irish Embassy and two more calls to USCIS to confirm, we decide he will stay.

12/02/03- Petition for AOS recieved

10/8/04- EAD FINALLY arrives

11/10/2004- Our Son Colin Michael Kieran born two years to the minute after our first face to face meeting!

1/26/06- Recieved interview appointment letter.

3/09/06- AOS approved! David is a permanent resident with stamp in passport.

4/4/06- Green card arrives. We are now free to travel back to Ireland so David can see his family for the first time in more than two years.

Isabel,

If the posted date is past your NOA date, your case is probably being worked on. If the posted processing date is 30 days past your NOA date, your case is officially overdue and you can put in an inquiry.

The purpose of the K-3 is to let you wait in the US for approval of the I-130. Without the I-130 you have no basis to become a Permanent Resident (your goal) so I'd suggest that it's very important to you!

Yes, you must immigrate. You can do this one of two ways: use an immigrant visa (the CR-1 interview in your home country) or by Adjusting Status within the US (AOS). Both methods have plusses and minuses, most of them depending on what your District Office's schedule is, and how difficult your home Consulate is. Choose the path that is fastest or easiest for you.

I-129fs are kept in Missouri and processed there.
