Hi guys! Just want to say I LOVE this site used it for reference through my K1 filing and all went smoothly. I couldnt have done it without all of you!

Im kinda stuck at this point and a bit freaking out and really looking for some input.

Our K1 petition was approved May 5th 2006 and my then fiance came over to the US on Sept 7th 2006. We were married within the 90days so all was well. Actually not so well, At the time of my husbands entry I was out of work on disability and because it was a difficult time we held off on filing for AOS until I returned back to work. During my time away from work my employer decided to replace me (grrrrr) and apparently was having a hiring freeze when I was released back to work so I was left unemployed.

Dealing with a new disabilty/immigration and unemployment was not something I planned to take on all at once and things kept getting pushed back a bit... okay pushed back a lot.

I was finally able to find a new job at half the salary I was making when I first filed although it seems I just make the cut for the 125% for the support forms.

My husband has now been in the country since Sept of 2006 hes not working we didnt realize he could apply for a social security number and employment auth along with the K1 (doh!) Oh yeah we missed getting his Social security number by one day! the people at the SS office said he had to have at least 14 days left on his visa and we missed it by one tiny day!! (thats another vent)

So, hes here hes not working (i wouldnt want to take any chances) and we have not applied for AOS. yes, we are working on it and have been the forms are pretty much ready to go but im afraid of whats going to happen now.. i mean are we going to get busted for not applying when we should have? Even though i seem to make enough now to support him are they going to look at my past tax returns and say no way and say that we need a co-sponser? During the time I was out of work I didnt apply for SSDI so no extra income during that time I guess I was too stubborn or too proud or in denial to ask for help and maybe just too angry at my condition to admit that I needed it.

None of which makes one bit of a difference now because we can only move forward right?

Anyone have any advice/insight for me?

K-1 employment auth before filing for AOS lasts only until the I-94 expires, so is a worthless EAD because it can take up to 90 days to get approved.

If you are currently employed, an employer letter indicating income, and job is full time. This along with recent pay stubs should show current income meets the requirement.

Is now a US Citizen immigration completed Jan 12, 2012.
