Can they Work once they arrive to America???

I need to know if my fiance can work once he arrives in the US!!!?????

I realize if he comes here on a fiance k1 visa, he prob can't attend college.... I think until he gets his greencard which is 2 yrs after marriage if I recall correctly (but pls correct me if I'm wrong on that too).....

Can our SO's work once they arrive in the STates??????? If so, what kind of paperwork do we need to have filled out in order for him to work? And how soon after his arriving to the States on a k1 fiance visa can he work legally???? :)

Thanks so much!!!! We've been dying to know this for months now!!! Now that it is getting down to the wire and he will be coming in the next couple months hopefully, it's time to find out the truth of the matter here!!! ;)

If your finace gets here and goes through JFK, there is a pretty good chance he can get the temporary EAD at the airport. It is good for 90 days and he can use that to work (but only for 90 days).

When you file AOS after he gets here you ARE applying for the greencard. You can also apply for an EAD as well so that if that gets approved before the greencard he can use that to work. That is good for 1 year. AOS times vary, some get it in a few months, others longer.

Some colleges do not require a greencard to attend classes. You have to check with your area colleges and see what they offer.

Not to be a downer....but plan as if he doesn't get the temp EAD (ie: save $$$) .....they don't have to give it out.....he could arrive and potentially be unemployed like many K1/ AOS pending people for 3-4 months. You can marry and file quickly for the AOS (which includes EAD) and that will help things along.

Even if he gets the temp EAD...it will likely run out before he receives the permanent one so there would be a gap between when he could legally be employed

Some colleges don't require a green card to enroll. The one my SO will be attending just needs the notice of receipt of our AOS papers, or he will be charged international student tuition, which is like 3x the money. But at least they don't make you wait until the AOS is approved. They just need the receipt.

I would plan on him not getting the temporary EAD. Then if he does, that's good. But if he doesn't, you're not in a pinch. And aside from that, even if he gets it, he may have trouble finding a job because it's only a temporary permit.

My SO is going to brush up on his English and Math skills in order to do better on the placement exams at the college. And he may get a volunteer job for the few months while waiting for the green card.
