I-864 Joint Sponsor Question

I have what I hope to be an easy question.

I want to use my mom as a joint sponsor. However, she files joint taxes with my father. Both my parents make enough money individually to be a joint sponsor.

So, can I use my mom only and then just show her W2s and they will understand that her salary is just a part of the Income Tax return that she shares with my father?

OR ... since they file jointly, do they both have to fill out I-864s?

Please answer if you actually know. Lots of people try to be helpful on here and speculate and it just gets confusing.

  • Feb 22 2010 - Date of NOA1
  • Mar 26 2010 - Date of Bio
  • May 10 2010 - Approved
  • June 2 2010 - Received Card in the mail

Our joint sponsor also files taxes jointly with his wife, but used only his income to qualify, so we just needed one I-864 (you can only have one joint sponsor anyways I am pretty sure). I would think you are on the same boat as long as you mom's income meets the requirements - otherwise you dad can fill in an I-864A (agreement between sponsor and household member), but perhaps a wiser members can bring in more precise information.

Natalie -- That's exactly what we did. My mom and dad file jointly, but only my mom was a joint sponsor. She attached her W-2s only to show what she made, and we didn't need to tease out on the I-864 exactly what was her part of the joint income reported as the W-2s did that for her. No need for my dad to do an I-864A.

I remember when I was trying to figure this out last year, I had NO idea what I was doing! But with a little steering from a veteran VJer I sat down and really, and I mean REALLY read the I-864 again and again and again... and then it all became a lot clearer. Good luck! :thumbs:

We did the exact same thing too. As long as you have the transcripts and the W-2s, you are good to go.

June 1, 2007: I-130 delivered at Embassy

June 1, 2007: Received packet 3

June 10,2007: Sent DS-230 part 1 by email

July 26, 2007: Applied for SVK police cert. at embassy in Warsaw

July 27, 2007: Applied/Received Polish police certificate.

August 7, 2007: Applied for CZK police certificate at embassy in Warsaw

September 5, 2007: Received SVK police certificate

September 5, 2007: Medical examination

September 13, 2007: Received CZK police certificate

September 14, 2007: Emailed form IV/F04 (checklist) to embassy saying we have all documents and are ready for interview.

September 28, 2007: Received email saying they couldn't open the attachment so I sent IV/F04/checklist by fax.

October 10, 2007: Received email confirming they have received fax

October 16, 2007: Received Packet 4

November 15, 2007: Interview, (had to have two police certs translated to English instead of Polish)

November 16, 2007: Two police cert. brought to embassy. Visa approved!!!!!

November 19, 2007: Visa in hand.

March 23, 2008: POE Chicago, IL
