Greetings All,

I do seek help from those who are more experience in K-1 visa refusal which my case is unusual.

My finacee went for her appointed K-1 interview in Guangzhou on the Jan 9th 2008. After the usual procedures (documents and appointment papers check), she was later called to the window for the interview by a Asian Lady. After the nice greetings and verifying her name was correct, the lady interviewer told my finacee that she applied before in July 2007. When my fiancee replied this is her first time and trip from a far away small town, the interviewer told my fiancee not to lie again. Then she pause for a while and started asking a few questions like how we met, how many times I visited her, when I reside etc. In the end the interview told my fiancee sorry she can't approve today and was given a white paper to go home. Obviously she cried all the was home and tears continue for a day and half.

What I don't understand is how she was accused of applying before and told not to lie in the first opening lines before looking at the documents. All the documents are in place and done according as requested. My petition for her started on Jan 17 2007 and finalised by NVC around August hence she was given the interview approval notice and package completed in China. I know for a fact that it is her first fiancee K-1 visa interview and I had coached her all the way since I know her the last 2 years. She is a innocent small town girl who agrees to marry at my asking based on our love and desire as husband and wife.

Could it be a mistaken identity or computer error that my fiancee interview went wrong. At this point I don't know exactly which direction to go and what is the best possible way to succeed.

I sincerely appreciate any advise and help on this matter.

What was on the denial/refusal white form? The reason why they denied your fiancee the visa would be on that white form. I doubt there is a case for mistaken identity, as they check on these things before things ever get to the interview stage.

Your best bet is to find out what is on that form the consulate gave your fiancee. Your plan of action will depend on knowing that beause if they denied issuing the visa outright, the visa petition will get sent back to the US and a NOID (notice of intent to deny) may be sent to you eventually....delaying your case by much. If they issued a request for further evidence....more picture or more proof of your relationship that is not a visa denial, just a refusal to issue the visa until certain conditions are met.

ETA: Did you fiancee ever apply for any other type of visa? Could your fiancee have misunderstood the question, and the IO may have meant that she applied for another visa last year in June, not the K-1, but say a tourist or student visa?
