You are working for a Canadian-based company, so US work authorization does not apply. I did the same. All the EAD does is give you the right to work for an employer in the US, and the US employer the right to hire you. Think of it this way..... when someone employed in another country comes to the US on business they do not have to apply for employment authorization first. That is because they are not here working for a US-based company.... they are working for a foreign-based company.

This is so wrong.... employment authorization is required for working in the US for ANY company that has US nexus

I agree with fwaguy. EAD is required to work in the US.

Here's something straight off the USCIS site:

"EAD: This document proves you are allowed to work in the United States."

Brad worked while in the US... even though the company was Canadian based.

You're right. The EAD proves you are allowed to work in the United States. Now...why would a Canadian company that Brad ALREADY worked for need proof that he is allowed to work in the United States? A Canadian company is not subject to the "EAD" rule of the United States as far as I know. A Canadian company can hire whomever they wish, whether they have an "EAD" or not.

Well maybe just maybe because his status is changing from tourist from Canada to potential green card holder in the USA now, maybe? Curious if you have such disrespect for the USA and it's laws, then why come here, work and live? It is rather amazing the disdain I sense in these statements from Canadians about a simple procedure with USA law, go back if you do not agree or like it in the USA, you do not see anyone on here from USA attacking or making rash disrespectful statements about Canada and the way they conduct their immigration affairs or laws. :whistle:

Interesting thread.

To make matters more simple... those of you still working for a foreign company- try to ensure that your salary is deposited directly into a bank account in your original country. Even if your work is performed here in the USA. For tax purposes, you'd be working for free since your foreign income, as a non-USC and non-resident, is not taxable (for IRS purposes). Financially, you'd still have access to your earnings by banking online or using your ATM privileges.

For USCIS purposes, however, its better to come clean by stating at something like an interview that your employer is compensating you in your country of origin for work pertaining to that country. End of story and problems will be avoided since the US IRS tax code will not be invoked at any point of the employment process and any claims against the foreign company falls under the legal jurisdiction of the country of origin as a financial enterprise in the domain of the employer and employee. Its a foreign relationship, not a US one.

They probably won't care anyway.

When I want to hear your opinion I'll tell you you can share it. Now you are free to apologize for slandering me. Nowhere did I say I have disrespect for American laws. You had better read my posts over again for the first time. And since when in hell did someone have to AGREE with ALL laws in order to live here. One can follow them AND disagree! If you have such disdain for the Constitution and Bill of Rights, then maybe YOU should leave. Thanks for the whistle but keep it for your husband. I'm sure he'd like it better.

Joe Canuk what you fail to realize is that how could he be working if no EAD or Green Card in the USA legally?? He better shoot straight, they will find out, and by the way he is wanting to come to the USA so yes they can and they will tell him what to do, believe it, we experienced it, you are in the USA now not Canada. :whistle:

The last time I looked, Canada was a sovereign country and the United States had no right to tell Canadian citizens what they can and cannot do in their native country. I wouldn't sweat it. It's none of their business and really nothing you need to tell them. Good luck.

Please, I never made a definitive determination as to whether EAD was required or not... I only commented that caution needs be excersised as the information initially provided is not sufficiently factual.

Joe has his opinion and he is welcome to it... but I also think that someone could innocently fall into a "trap" if someone blindly follows it....
