My fiance' is Canadian. I am a US citizen. She wants to come here and be married. Niether of us have any idea what we need to do to get started. I am on probation for DUI and not employed right now.

Take a look at the top of the screen, on the tab where it says "Guides." Start there, or click here. Click on the link that says "What Visa do we need?" From there just follow the guides where they lead you. This should give you at least a few hours of stuff to read through. After that, come back and feel free to ask more specific questions, but keep in mind that many common questions will already be answered for you in the guides and the FAQ, which is the last tab at the top of the screen.

Best of luck to you!

1) File an I-129f petition for a K1 visa.

2) Get a job so that you can financially qualify to petition her or find a family member or friend that is willing to be financially responsible for her.

3) The criminal past of the petitioner generally doesn't come into play unless they have history of domestic or sexual abuse.

K-1 means she can come there to get married and stay after the marriage, but she can't leave the US until she gets her greencard.

K-3 means you can get married but she can't stay and live in the US until the Visa goes through, once she gets her visa she can move to the US and apply for greencard, and can come and go from the US as she pleases.

CR-1/IR-1 she has to leave after the marriage but will have her greencard as soon (after mailing it to her) as she enters the US on her visa, can also come and go as she pleases. This one generally takes a little longer than the others, but in some cases can be the same or even quicker.

It just depends on what is important to you. The K-1 gives you a chance to get to know each other a little better before getting married (90 days), and you can stay together after the marriage. The others have benefits too though, so reading the guides (as suggested above) is a great way to start to decide which one is for you. Good luck!
