Hello,

I am very new here, as of today. I have been looking around on this site for a couple of months now tho. Im not even sure what to call what I have applied for. Im still educating myself. In a nut shell, my finace was deported from USA 8/2007 after overstaying voluntary departure by about 9 years. We had to cancel our wedding plans that were set. I went to his country to marry him late last year. When I returned in 12/2007, I met with our lawyer and sent in paper work requesting what I think is a spousal visa. We received NOA dated 2/1/2008.

What my lawyer has discussed with me seemed so confusing and overwhelming. I was taking notes and writing down numbers frantically. What I think I understand is that my husbands visa will be denied and I will have to apply for 2 waivers, one for hardship and one for deportation. Thanks to VJ, I believe that is I-160 and I-212. I was sent a sample affidavit and outline for hardship info to help me. I have to say that it made me cry. I can barely keep it together as it seems so difficult and makes me feel that the government doesnt care. I miss him so much, we talk everyday on the phone and the bills are high, but worth it. Any advice would be greatly appreciated. I am in for the long haul and expect to become very familiar with VJ and this process.

By the way, I'd like to make a suggestion that, for the sake of consistency, each of us use the "Notice Date" given on the NOA1 as the date for lawrence-jeramie's table, rather than using the date that you actually receive the NOA1 hardcopy. The "Notice Date" is the official NOA1 date as defined by USCIS, so it makes sense to use it.

Hi, yes, I too have just embarked upon this horrible process. I mailed my I-130 on Jan. 7 by FedEx. It was received and signed for 2 days later (the FedEx planes did not leave for Chicago on 1/7!). That is all I know for now.

I have done so much research on this - in fact, the lawyer I paid to look over my paperwork cut his price in half because he said I had done everything perfectly! - but even since then I have discovered so many things that could have been done differently.

For example, I just learned today that you should put your photos in a plastic bag. Didn't do that. Didn't photocopy the *back* of my birth certificate either - there is nothing on it!

And someone on this forum was saying that you could file the I-130 and the I-129 TOGETHER! Every other source I have seen plus the lawyers I spoke with all said you had to wait for the receipt of the I-130 to file the I-129. AARGH - it is frustrating that no matter how much research I do, there is always something new about this process.

Just trying to keep a sense of humor about it all.

Thank you for starting this thread! I had just logged on to do the same. I think we are going to need all the support we can get!

Husband home and only find NOA1 for wife, dated Feb.08( check was cashed on 2/12 ) , there is no NOA1 for our baby even her check was cashed at the same time. I am guessing her number is next to my number, and load into USCIS web and find the guessing number do exist, but not sure if it belongs to her. Husband call 800-375-5283 but does not sort out anything.

Does any expert now how to find out the NOA1 number? Is the only way is talk with CSC ? Anyone know CSC direct number with someone there talk to you ?

You can find your case number on the back of the cashed check. The paper NOA-1 will say the beneficiary's name, so I would think you would receive 2 NOA-1s, one for your wife, one for the child.
