Timeline

Hi, my fiance is a resident of the U.S.A., and i'm an J1 international student. I'm just wondering...if we decide to get married while i study here, what kind of visa should i apply for? Thank you very much-! I'm sorry if i'm posting in the wrong place, because i really don't know where to start-! :blink: Thank you all-!

If you have a 2 years home resident restriction you gotta go home and file for a waiver.

If you're planning on going home and THEN applying, read the guides with K-1/K-3 pros and cons and see what's best for you

If you did not know her or had no intention to marry her and immigrate when you last entered the US, and if your student visa does not require that you go home for two years afterwards, and if you do not need to go home anytime soon, your best route is to get married in the US and then adjust status by filing the I-130 and I-485 together - no visa needed.

A visa would be needed if you did have intention to immigrate when you entered, and then you would need to go home for the visa interview and return with a visa.

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

SInce your fiance is a resident and not a US citizen, you can only go for IR-1 visa - and that for residents is a 5yrs wait if I am not wrong. Does your fiance have any chance of getting his citizenship in the near future? If so, then you might not have to go home and wait there but could apply for AOS. You can't do K-1 visa as he is not a USC.

That's an excellent point. I didn't take "resident" to mean literally resident and not USC, but you may very well be right. :)

I'm sorry...i don't know what was wrong with me, i'm a F-1 student and my fiance is a us citizen....something is wrong with my head...probably because school just started this week.....

Does your student visa have a two year home requirement?

Oh...thank you-! But i'm on f-1 visa right now, which gives me 5 years to finish school and i don't see anything like a two year home requirement on my visa....maybe i could get married first and then file for adjust status? Is there more that i need to know and do? Thank you very much-! I'm sorry, i was a j1 student a few years ago, but now i'm on f-1, i was not thinking when i left that message....and my fiance is a us citizen.
