I wonder if anyone can give me some advice. My fiance is British, but is an American national. We both live in the UK and are getting Married this month and will be applying for a Spouse vise.

I've just recieved my police certificate which shows the only conviction on there which is from over 20 years ago when I was 19 years of age. The crime was criminal damage and I was fined £50. That is the only conviction I've ever had. Do you see this being a problem and also, do I require any other info from the court archive to send in with the police certificate regarding this crime.

If by American national, does he have "Dual Citizenship" ? And if so why are you applying for a visa? If he has dual citizenship, this is a marriage of an American to an American no visa required to enter the USA.

If he does not have American Citizenship, then yes the conviction may pose a small problem and may need a waiver filed to overcome it.

Also if you are applying for a Spouse Visa in the UK, you will be filing for a CR-1 (DCF) Not a K-3 as per the forum you posted this in.

Maybe I should have explained myself a little better. I am a UK citizen and my fiancé was born in the UK, but lived in the USA for 12 years and is now a duel citizen. She has lived with me in the UK for the last two years and now we are getting married and plan to get a spouse visa for myself in order to move to the USA. We are collating our information to submit and my police certificate shows the above. Thanks

Hello there! :) I'm not knowledgeable enough to say whether or not it will be a problem, but I can say that you should be applying by direct consular filing and that the police certificate is not seen until the interview date. So you have time to look into it and see if there's any additional documents you should bring to the interivew. For now, your wife just needs to focus on filing the I-130 with the USCIS office in London. Here are instructions on how to do it -

This is the fastest and best route to obtain a US spousal visa so be glad your wife lives in the UK with you! :)

Perhaps you're already doing this though and just posted in the wrong folder.

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly
