hi everyone...I've been debating whether or not to apply for the AP for my husband. He wants to but I am hesitant b/c if USCIS denies his AOS or does something else crazy while he is not here, then he's stuck. I have heard of quite a few cases of families from Pakistan that this has happened to and am really cautious. They apply for AP, go to visit home and then their PR or citizenship is denied and they are stuck on their vacation.

Has anyone here been scared of that or am I just being a bit paranoid?

I-485 , I-765, I-130: NOA1 : 1/23/2006

Biometrics 2/23/2006

Temporary EAD given for 1 month ONLY b/c of Infopass appt: 5/1/2006

Went back to renew EAD through Infopass: EAD card was not given "due to reasons we can't disclose"

5/3/2007: Confirmation that EAD is delayed due to background checks. (started to use the senator, ombudsman and was just a royal pain in the neck)

5/30/2007: EAD production ordered (after over 400 days of waiting!!! woo hoo!)

AOS Interview: 5/12/2008!!! FINALLLYYYYYYYYYYYYYYYYYYY!!!!!!!!!!!!!!!!!!!!!!

7/29/2008: card production ordered...918 days..can't wait to see that card!

That's not paranoid. You should be scared. The applicant can't actually leave the US until AFTER the AP is actually approved. If your husband leaves without prior AP his AOS will be considered abandoned by USCIS. Also, he risks not getting back into the US as it is illegal to try and enter the US without proper documentation and the intention of staying without documentation. He even risks being banned from the country for up to 5 years. I've heard of Canadians doing this because you can always "sneak" back across the boarder but from Pakistan I'd highly suggest against it.

Although I've had a HUGE problem getting my AP, I would suggest applying for one.
