If you have all been following what has been going on with the May/June K3 filers.. especially those with the VSC, you will notice the trend of people having the I130s approved months before the I129Fs to the point that most assumed the I129Fs were dead (in my case, I was told it was going to be terminated once it was taken off the shelf) but we just saw two people from this group have those same "dead" petitions approved.

I am supposed to pay the IV Bill for the CR1. The bill is $400. I should have paid it today but I couldn't get a second away from work to sneak to the bank. I felt horrible about it all day but now i'm wondering if it was a blessing in disguise. I was told, using the RFE trick AND my senator was told by someone at the VSC that because my I130 was already approved my I129F is going to be terminated once it is on an adjudicators desk. According to the website, it is still "pending".

I am scared to pay the $400 and having them say the I129F is approved. Don't get me wrong... getting that I129F approved is my biggest wish right now. It TAKES FOREVER to get a CR1 interview in Nigeria. My husband and I have been really having a difficult few weeks. Should I push to get it on an adjudicator's desk? If so, how is that done? Is there going to be a record of them telling my senators that their policy is to terminate it, which could in turn cause the adjudicator to terminate it? Any advice?

I'm not really sure of the path you should take (only you can decide that :) ) but, if it was me, I would be worried about delaying the CR1/IR1 for even longer than it has been already.

If you're not sure whether you can 100% get an approval on the K3, I think it is too much of a risk to take to stop again with the CR1/IR1. Have the people who have been approved recently ( A) continued with their CR1/IR1 process because they thought their I129F was dead or ( B ) were they holding out hope of an I129F approval?

Unfortunately you know that USCIS will not admit any deviation from their "confirmed processes" even if some people have been lucky enough to slip through. So if you try to argue the case they would probably just tell you that you are mistaken, after all we can't quote specific case numbers to prove our point (the same thing they tell people when we see approvals being approved way before their time)

I wonder if USCIS even bother to check with the NVC to see if a petitioner has continued with the petition sent to them.

I think you'll be the only one that knows whats best for you.

In my case, my petitions were paired up together. I know because they both get touches at the same time all the time. I was also told by an agent that it was paired up. I was so happy expecting them to both approve my petitions on the same day.

When it was time to process my petitions, they processed them at the same time, but USCIS decided to approve my I-130 and terminate my I-129F.

Although I wish USCIS BOTH approved my petitions, I decided to not fight it and go full steam ahead with our I-130.

My goal was to be with my wife as soon as possible. Believe it or not I figured it would take a lot longer to fight USCIS.
