Hi to everyone.

I am an italian citizen and my girlfriend is american.

We need to understand how to proceed and what's the quickest and sure way.

We would like to get married avoiding the fiance visa. Is this possible?

For my understanding we have to fill the I-130 and i am not sure about what else form. Please could any of you clarify me.

I also need to know how to have a work permit and if it's possible to fill it in with the I130 in order to be able to work while waiting for the green card

Getting married wont make it any faster. If you do not have a visa you can apply for the K1/3 type visa with the intent to marry once it is granted. I think its around 90 days after arrival.

If you marry you can apply for the CR1 route to get a Green Card. I would estimate the whole process to take about a year total. Normally people apply for the K3 at the same time so they can travel to the US.

You will not be able to work (legally) until you get final approval, and get the Green Card and SSN.

I am doing the IR1 route so I dont have all the answers. I am sure someone will chime in soon.

If you are not married, and want to marry in the USA, then file a K1 (I-129f) visa petition.

If you are married (or get married before filing) you file the I-130 petition.

After you get your case number for the I-130, you can file the K3 (another I-129 form) where the K3 is supposed to be faster than the I-130 by a few months.

A couple of considerations.

1) The K3 is expensive, you pay for the I-130, then also the I-129. Then when you are together in the USA you must file AOS and pay for it.

2) If you go K1 or K3, you can not work until your AOS is processed, People say 90 days, but I would expect it to be longer these days.

3) CR/1 (I-130) provides a ss# and greencard immediate when spouse enters america first time.

4) If you file the K3, USCIS will hold your I-130 paperwork, and only process the K3. No chance you can get the I-130.

5) Look at other peoples time lines for your country to get the estimate of time difference between K3 and CR/1. For me it was only about 1 month, and I saved about 3 months at NVC, so my CR/1 may actually be faster than some of my friends K3.

6) K1 and K3 visa can not leave/re-enter america until AOS is complete, or they must apply or early parol. CR/1 (I-13) visas can leave again anytime as they are already greencard holders.

All that listed, imho, I dont see why anyone goes K1/k3. CR/1 is just a much better visa in exchange for a few more months wait.

It looks like there are 2 paths:

- K3 visa

- I 130

The problem is to have an accurate timeline.

I would prefere to do the I 130

I was watching the stats but i coulnd't sort out which way is the best.

I can arrange to have a job when i come to the US. I am an engineer working for a big US corporation. I have been asking for a transfer but due lack of experienced people in europe (Italy) they do not let me go.

Suggestion are welcommed.

08/22/2008: Received RFE for Affadivit of Support and Medical

10/21/2008: Submitted I-865W in lieu of co-sponsor and medical info to NSC

11/14/2008: online case status not updated since filing of AOS in July 2008

01/20/2009: Received another RFE for Affadavit of Support Info

02/02/2009: Responded to RFE with brand new AOS based on 2008 tax return (if that doesn't shut them up, dunno what will)

02/19/2009: EAD card received in mail (no updates on Online Case Status ever made)

02/23/2009: AP received (again, no online updates)

02/26/2009: Received interview appointment letter for 4/6/09

04/06/2009: AOS approved for unconditional GC

04/21/2009: GC received
