Hello all, when I was looking at the visa in my passport it states the date of issuance as being Jan 4/ 08 ( the date of my interview) but the expiry date is listed as July 03/08. Shouldn't it be good for a year?

Not sure about length of validity of CR-1/IR-1 visa from Canada, State department table does not list immigrant visas.

http://travel.state.gov/visa/frvi/reciproc...ocity_3531.html

However, I would delay entry to the USA on that visa until after 2nd wedding anniversary (4/21/08), when you enter the country, show the POE officer your marriage certificate, and they should recode your green-card as the 10 year permanent one, NO conditions to then lift 2 years later.

I can't delay on entering because our daughter would be left without care. Although, maybe they can/will hold off on activating the visa, but in the end I just want to get this whole thing over with.

You can try asking them to not activate your visa and tell them you are visiting and on returning will activate it. Hopefully they let you in just as a Canadian tourist.

I would try and avoid using the visa until after 2nd wedding anniversary, filing I-751 to remove conditions costs $545 now, who knows what they will be charging 2 years from now.

Usually they give 6-month time to enter into the USA with immigrant visa. For OP's case, it is possible that the medical will expire after 3 months from the visa issuance date.

Another thing, you can not delay on entering. You have to enter into the USA within the immigration visa expiration date. If one wants to extend it, he/she has to submit a new DS 230 along with the IV Fee, plus he/she will be interviewed again. So the idea of delaying does not make sense.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

In my case our second year anniversary is April 21, so I would hit it before my visa would expire.

I guess I was confusing it with the I-551 stamp. Does the CBP agent stamp that in my passport?

ya, one has 6 months to use the visa!! If ya needed it extended, I'm sure ya could email Mtl and they could say yes or no! Once u activate it at the POE, it is good for 1 yr, but u should have ur actual card way before the yr is up!! And likek they said, if ya activate it after 2 yrs of marriage, you should get a IR-1 visa. Save ya some filing charges!

The stamp the POE officer gives ya is just an ink stamp, but it is the one that makes it valid for 1 year

Edited by flames9

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied, that is if ur polite and didn't lie! Refer to #1

But they won't allow to extend the IV visa. One has to file DS 230 again along with IV Fee plus he/she will be interviewed again. So why does one want to go through all again? For most cases, one is not interviewing to remove conditions when one applies to remove condition in USA.

I know someone who emailed Embassy thinking he can extend Immigrant Visa for 6 more months. What I said was exactly told by the embassy. But yes, it does not hurt to ask the Embassy for visa extension.
