1-864 and I864A

ok, I have been reading and reading on this and trying to figure out what to do. My mom filled out an I-864A and my step father as well. I am the sponsor for my husband, but my income does not meet the requirements. As of now we are temporarily living in italy, but as soon as the green card is ready, we are leaving to the states... and we will be living with my parents. Now I know the I-864A is only for household members, but to me it makes sense that that would be the correct form for my parents, and not the I-864 to be joint sponsors. I could be wrong, but this thing is so confusing, and I hope that the I-864A will work, because otherwise, I dont know how the heck I we are going to get them to finish the I-864 and then send it, and me recieve it on time (my interview is in a week) I just ran into this bump today when I called the embassy, and they said that an I-864A wasnt the correct form for my mom to have filled out. I am not sure if it was just the woman.... or if there is truth. The whole thing seems legitimate for them to fill out an I-864A, the only thing I am thinking is that maybe it would impact it, the fact that I am in Italy now.... and my residency isnt with them at the moment.... but it will as soon as my green card is ready! AGH I AM STRESSED! Goodness, anyone any imput that might help me..... if they do have to do the I-864 and be joint sponsors... then I guess that I could try and get it Fed Exed here..... I dont know!!! :help:

US Citizen spouse MUST sponsor their immigrant spouse. So even if income is low he MUST still provide an I-864.

Joint-sponsor should fill out an I-864 also.

I-864A is only used in cases were a household member contributes a set amount of income as support, and can be helping either the primary or joint sponsor.

Ok... this much I understand I guess my biggest question was just that.... if I have lived with them all my life, and am living in Italy temporarily now, and doing Direct Consular Filing, then going back to living with them.... can I still count them as household members... even though at this moment in time, we are not in the same house?

No you cont only people who are your dependents as members of "Your" household. You may be apart of your parents household if your parents if they claim you on their IRS return.

Again Joint sponsor files an I-864, and the joint could use assistance from a member of their household if needed, that member then uses I-864A

Hi

After reading your post i went and read this any one can b used as household income can be siblings, parents etc with the same primary address. Or any dependents as well that u include on your federal taxes uncle, grandfather all these ppl can help u but the thing is u have to share same household address with them to use as household income. But u also have to include your income information too. U may have to use ur parents addy for everything dont list italy since u are not a resident u are just there temp thats what i would do ...

You have to fill in your own I-864. Your parents as joint sponsors would fill in ONE I-864 and ONE I-864A in case more than one person's income is being used to fill in the requirement. You would need both forms for your interview - no way around that one. Have them Fedex'ed to you asap. good luck!

As you are filing directly, that means you are saying you currently live in Italy. So you are not currently part of your parents' household. One parent should fill out a I-864 as the only joint sponsor and include the other parent's income, and the other should fill out a I-864A as a household member. Get them print out the forms online and FedEx them to you overnight. The woman at the embassy was correct. You will also need to complete a new I-864 without your parents or their income included in your household. Good luck! :)

ALSO you may use up to 3 yrs of tax returns to meet requirements if 1yr is not enough, this is for you . If you dont want to use them u can combine 3yrs taxes to increase your income .

This is completely untrue. Where did you hear or read this?

This also bad advice. She is filing directly in Italy and is only allowed to do so since she is currently living in Italy. She was correct to use her Italy address and should continue to do so until the process is complete and they move to the US.

I am pretty sure that they would need to share the same primary address though.

It is a good point that the I-864A is only needed when if the parent filling out the I-864 as the only joint sponsor cannot meet the requirement with their own income. :)

Agreed Margot :thumbs: - it is upsetting when even well intentioned folks give wrong advise. My take is, if I don't know the answer or I am not certain, I say so. Otherwise it's gambling with people's lives.
