Hi to those I-130's out there sitting in this terrible backlog.

My husband sent out an e-mail to alot of senators and goveners just last friday (4th dec) he got a very nice letter form his senator along with a permission letter from the senator requesting to access our files that we sent to USCIS back in October 18th 2007, which he as signed and faxed back. Our attorney is very impressed of the quick response. The senator said in his letter that he wants to help get our case approved in a timely manner and ensured my husband that he is on the case so we shall see. I know its early days but with the backlog we still have no NOA1 nor has our cheque been cashed so he took the action of seeking help through his senator.....Thats what these people are here for so no harm in asking for help right ?

I know this may not make any difference and we are NOT asking for a favour like to be pushed through My husband is simply asking the Senator to see if he can locate our file and find out how long its all gonna take and since there is a backlog it would be nice to know what he finds out. Ofcourse we want this process to go quickly as husband and wife we want to be together but just knowing where it is and when we should look for it to get to London, UK for me to go for interview would be great...lets see what the outcome will be :)

The senator acted fast on my husbands e-mail, only took 2 days to get a response so thats a good sign :)

Good Luck to you as there are others way before you that have not had this avenue to pursue (Congress person or Senator unavailable or to busy campaigning) - I did find out one thing that may be of help....normally your Senator will want that elusive NOA1 number to try and help - there are probably pallets upon pallets of I-130's sitting on the floor in Chicago and to search for your application without a receipt number will be a monumental task.

We waited for four months finally got ours, finally key word. Others before us are still without, in contact with their Congress peeps and Senators, and still there is nothing that can be done but again, I wish you luck in your quest to find the application and if these seems a negative respond, tis not, for I applaud for taking a pro active stance to make our plight known in each and every county here in the USA - what becomes of the Senator's aid in finding your application is another story.

Husband home finally - god what a journey....but after 400+ days we made it

Have a little patience --- something very necessary in this process.....

We do have paitence and did not ask for any special treatment but remember senators are there to help US citizens are they not?

Also don't be so rude in your response !

My husband has as much right to contact his senator as any other USC!

Since USCIS shows Chicago processing apps with Sept dates now, your's probably hasn't been opened yet, so there's no way to track it. The receiving of apps has just recently been speeded up and people have been waiting 6 months just to get the NOA #1, so if you want to post about contacting a Senator after 3 monts, be prepared to take a little flak. Many people here are very frustrated.

I contacted my senator before I filed and I have a congressional inquiry form just waiting for my NOA 1 to show up. Though I wonder if the number from the back of the check (when its cashed) will work just as well.

There is nothing wrong with contacting your congress critters to get them to take action. That IS what they are there for.

There is nothing wrong with contacting your Congressman. It's a privilege to be able to do so. Nevertheless, I struggle with making that decision to do so. My wife is pregnant and living in the Philippines. I want her with me just as bad as anyone here desires to be with their spouse. At first, I thought I would try to expedite the visa process so my child could be born in the U.S. and receive U.S. citizenship. I later learned that my child will be able to have citizenship even if born abroad. But while I was considering trying to expedite, I read here on VJ from a previous USCIS worker that Congressionals get special attention. And so I've struggled...do I get my congressman involved so I can get my wife here quicker? Or do I wait out the NORMAL process like everyone else and only get my Congressman involved when things out OUT OF DATE! I've decide with the later. It's my decision.

You are right that your child will be a US citizen, since you are a US citizen. You will have to report the new born's birth at the Embassy/Consulate. You can try to expedite your case by involving your Congressman, US Senator, but NVC only expedites a case, if it falls under "medical emergency."

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Senators and congressmen can only help when your wait is outside the normal processing times. They have no authority to expiate a case or demand an approval. Essentially, the only thing an official inquiry does is when people are outside the normal processing times because they have not been assigned an adjudicator is shine a light on the file.

I have been in your situation and I can tell you first hand, that your wifes pregnancy is not grounds for the USCIS to expiate your case. Although, I hope that you find your approval soon and interview before the blessed event.

contacting your congressman or senator make people feel better at least but to tell you there is nothing they can do till it is past the uscis processing times. they will send you a copy of the processing times and tell you to recontact them when the time comes and if you have any other questions to contact there aid so and so. thats why uscis put the processing dates so far back so they are never out of date good luck

I think that people on VJ get upset when someone says that they are asking their senator for help because they are under the impression that that will somehow jump the asker to the front of whatever line they're in. That is not true, if you're within "normal" processing times your senator will do nothing. However, I think that all of the USC's that get annoyed at the wait time should contact their senators and congresspeople -not to help out a specific application, but because unhappy constituents are the best way to get Congress to look into an issue. So please, everyone who has been separated from your family for months/years, write or call you representatives. Lets continue drawing attention to the fact that US citizens have to wait years to live with their family.

I don't think any knowledgeable VJ thinks that people who appeal to their senators are going to be able to jump the que.

However, USCIS employees having to address fruitless inquiries can impede the process for us since instead of spending time adjudicating petitions, they are replying to senators aides.

Exactly correct.

I asked a Senator for help. I got a responce but it resulted in absolutley nothing. They can do nothing to break the log jam. Rather they just become another log in the pile!

I think getting a Senator involved is most fruitful when/if you get to the point that you are out of the "normal" time boundary (unless, of course, there is an urgent need for medical expedite) or if something really unusual is going on with your case. I did involve one of my state's Senators recently, and, right after he had his immigration liason write to the embassy, the "problem" miraculously got fixed. Coincidence? Who can really say? One never knows with this crazy process... I'd say you have to do what feels right to you and your spouse, however. Good luck!!! :)

Summer 2003- We met (in the U.S.) and began dating.

Summer 2004- My SO moved back to Egypt; I spent a month there with him.

December 2004- SO called my parents and got permission to ask for my hand in marriage; They said yes, of course!

Christmas 2004- I traveled back to Egypt and accepted his proposal while we were on the sands by the Red Sea...

July 2005- Got married; I moved to Egypt

Nov. 2005- Began the immigration process!!!

July 2006- Hubby's immigrant "interview" at embassy in Cairo was no interview- told to file waiver for past visa overstay

Aug. 2006- Waiver sent from Cairo to Athens

April 2007- Waiver transferred from Athens to Rome

August 2007 - I moved back to U.S. from Egypt in anticipation of waiver approval (just had a feeling!!) and to continue my career because my 2 year work contract had expired in Cairo and my wondeful job was still here waiting.

Nov. 2007- Waiver approved... thank the good Lord!!!!

Dec. 2007- Interview- but not really an interview- just had to sign the updated DS230; Told to expect visa in 2 weeks.

Jan. 2008 - Visa in hand! It actually did arrive in 2 and a half weeks... Hubby back in our home 2 days later!!!

Feb. 2008- Green Card arrives

Today and everyday- Loving life back in our home, having a blast, enjoying every moment with family and friends, praying for all of you still waiting! Miracles DO happen!!!
