What if I am Late in Applying to Remove the Conditions on Residence?

If you fail to properly file the Form I-751 (Petition to Remove the Conditions on Residence) within the 90-day period before your second anniversary as a conditional resident, your conditional resident status will automatically be terminated and the USCIS will order removal proceedings against you. You will receive a notice from the USCIS telling you that you have failed to remove the conditions, and you will also receive a Notice to Appear at a hearing. At the hearing you may review and rebut the evidence against you. You are responsible for proving that you complied with the requirements (the USCIS is not responsible for proving that you did not comply with the requirements).

The Form I-751 can be filed after the 90-day period if you can prove in writing to the director of the Service Center that there was good cause for failing to file the petition on time. The director has the discretion to approve the petition and restore your permanent resident status.

You should be okay, though. Going by your timeline you're within the 90 days.

The IO told us yesterday that if you don't remove conditions than you'll be deported. She gave us a paper as a reminder.

The fingerprint card is only needed if you are filing the I-751 overseas, the biometrics appointment takes care of this in the USA. Edited by YuAndDan

Make sure you are looking at the most up-to-date form (available online from www.uscis.gov)

You won't use a fingerprint card, you will be fingerprinted and picture taken at your biometrics appointment, unless you are stationed overseas on US military orders.

it is called removal of conditions and it is a conditional resident card...

from the looks of things it looks like you still have time to file.... you can file anywhere between 90 days and the day your card expires...

thats is soo bizarre I swear I didn't see any other posts when I opened this thread :unsure:

We used personal check so we know when it is cashed & be able to expect the NOA (and drive ourselves crazy waiting for the NOA :lol: )

So I guess it doesnt matter which I send then. I will send personal check because it has both names on the account. :thumbs:

But need to send 2 separate checks, one for application and one for biometrics, right?
