Hi everyone.i have a question.Im starting to gather all the documents that we'll be needing once we file for a fiancee visa petition,he's been divorced for 2x,i understand that we need to submit a copy of his final divorce decree along with other documents that are required for k1,but since he moved a lot during the previous years and it's been 26yrs since he got his first divorce,he already lost his copy of it.my question is,do we need to submit it together with his 2nd divorce decree?can we just submit the latest one from his 2nd wife?

just want to be enlightened by this.i appreciate your replies.thanks so much .

09/25/2005 - Date when I filed for Declaration for Nullity of Marriage (Manila RTC)

01/04/2007 - Met my Fiance on MySpace.com

05/04-12/2007 - First visit

07/16/2007 - Pre - Trial hearing

10/05/2007 - First hearing

01/11/2008 - Decision granted

02/13/2008 - Court released the finality

02/22/2008 - Sent my fiance all the docs needed to file for a K-1

03/12/2008 - Received the docs that i sent him

03/13/2008 - I129F sent to CSC

03/14/2008 - I129F delivered at CSC signed for by E.Galindo at 11:10AM

03/20/2008 - Check cashed

03/21/2008 - NOA1 received thru mail

yes your fiance need to secure the two divroce certificate of his previous marriages. During the interview the pre-screener ask me the certificates too.

06/11/08 : EAD CARD IN THE MAIL!!!

07/02/08 : GREEN CARD PRODUCTION ORDERED

07/07/08 : GREEN CARD IN THE MAIL & WORKING

03/27/09 : Driver's License issued

Removing Condition

04/03/10 : mailed to Vermont

04/08/10 : NOA1 & 1 yr extension

05/20/10 : Biometrics Appt.

11/19/10 : Interview/Approval

You will need all divorce decrees and marriage licenses, there are no exceptions, (you can make copies of these when sending with the forms for initial filing) however, you 'will' need the orginals from the state or states you have been married & divorced in to be sent to your fiance' for the interview to aquire the visa.

If he doesnt have the originals, then contact the county where he was married/divorced. You can order copies of the originals with the state seal etc. and those acceptable from the county/state.

8-13-2010 - Biometrics Finished

8-30-2010 - email received 'card production ordered'

8-31-2010 - touch (updated on uscis as approved)

9-4-2010 - Received 10yr Green Card ** Now we relax **

My first marriage was in 1991 then i married again to my US citizen ex wife in 2006. Im awaiting on divorce so when i apply for the K1 do i need both marriage licenses. I knew about the divorce decrees but why do USCIS need previous marriage license? I find that a bit odd.

A man needs only certified copies of the divorce decrees. A woman might want to submit a marriage certificate if it is the only way to document a name change. For instance, the birth certificate says Jones and the divorce decree indicates Ms Smith and Mr. Smith divorced. Passport name is still Smith. How do you document that the Ms Jones on the Birth certificate is the Ms Smith on the divorce decree and passport? In such a case, you provide a marriage certificate (not license unless they are both in the same document) showing Ms Jones married the Mr. Smith on the divorce decree. There could be other ways but this is one of them.

Hi,

He will have to get a certivied copy of his first divorce. I recomend that when he does he get 3 copies. He should also get certivied copies from his second divorce. When you file you can make copies of them and send the copies. That way he has the certivied copies incase they ask for them. And when you get to the end of the journy he will be able to send you a certivied copy for your interview, and still have a copy for himself. Make sure you have plenty of copies of everything you send. And have him e-mail everything to you that he summit. It is better to send documents that you think they might need or want, even if you do not think you need to.

I was required to submit copies of my divorces. He should be able to get a court certified copy of the first one from the court that processed the first divorce.

I believe in the forms needed for a K1, if that is what you are filing, it requests marriage/divorce records ...but I will check again. Dates married/Dates Divorced. I provided both.

They ask on the petition what other names used, also they can figure it out by the dob and ssn, cuz that never changes

Hi everyone.Just want to give u updates regarding my question about my fiance's divorce decree.he already ordered a copy of it online and was already informed by LA County that it's now being processed and will soon be delivered at his home address.also,i already got my annulment decision.now i hope u still have some time answering another question that just popped in on my mind,is it the finality or the annotated marriage certificate that we're going to submit together with the required docs?will it be ok if we will just submit first the annulment decision?
