I am trying to complete form I-130 but got confused on question number 22 on part C. My husband is not in the US so I thought I would not have to complete this part. However, I am struggling with the sub question on number 22:

"If your relative is not eligible for adjustment of status, he or she will apply for a visa abroad at the American consular post in: City, Country"

I plan to file the I-129 once I receive the i-797. The American consular post would be Manila, Philippines. However, I am concerned that he would have to go back to the Philippines to apply for adjustment of status in case he comes to the US via I-129F (K3).

Do I need to complete question 22 at all? Any information would be appreciated.

Your profile says "Filed for K-1" yet your are talking K-3?

Anyway, I keep saying consider carefully the K-3, it has the big down side of Adjustment of status $1010, and also is not work authorized, you have to wait 90 days or more to get EAD to work.

Consider just filing the I-130 for CR-1 and not filing the I-129F, it has the benefit of green-card upon entry, allowing immediate work, no AOS to deal with to get the green-card.

And yes you do not need to complete question #22

sorry, we thought of filing for K-1 before but we decided to file for K-3 instead..i'm a newbie, i can't figure out how to change that..:-)

Again compare CR-1 and K-3 timelines for Philippians you will see that they are not much different, CR-1 takes a bit longer to process, and saves you much pain later with further dealings with USCIS
