Just got hard copy of my I130 approval. It says that they have forwarded my case to NVC. I was confused coz I filed K3. I thought they will hold onto my I130. So I called our little misinformation line.

I was told by the agent the my I129F was on "administrative close". He said, based on the "new procedure", they have to close the I129F and just approved the I130.

#######? Has anyone heard of this new procedure? People have no option now?

I would be very glad that they moved the I-130 it results in the superior immigrant visa no adjustment of status needed ($1010) and NO waiting 90 days or more to get EAD, and even longer for AOS to result in a greencard.

I know its a better visa. I was just upset for a few reasons.

#1. My I130 approval got heavily delayed because they paired it with my I129F and took the I129F's date as the priority date.

#2. They left me no choice! It is my understanding that K# gets processed so much faster at the NVC.

Anyway.... Sorry. Just venting a little bit. We're at the mercy of the USCIS. No matter what we want to do, they'll do what they want to do.

I'm sure this turned out to be better though. I just wish I knew this from the start and didnt file the I129F to begin with. My I130 could have been approved much faster.

its retarded to be dealt with this kinda chaotic approach. I think this moronic service center doesn't know what it does or understands the process ever. Defines and redefines as it feels necessary. I hear your pain abt NVC, all I can say is just hope and pray NVC gets it act together and u can leverage the Jamie's Shortcut route.

This has happened to several VJ members. What the person you spoke with probably meant to say was that USCIS closes your K3 petition if the I-130 is approved first.

This has happened to several VJ members. What the person you spoke with probably meant to say was that USCIS closes your K3 petition if the I-130 is approved first.

They paired my petitions. They could have approved both at the same time, like they did yours but... NOOOOO.

"They have decided" to just approve the I130 and close I129F.

Anyhoo... Like I said, I'll just go with the flow. I don't want to fight this and insist on K3. I'm afraid that USCIS will get "confused." LOL

Your timeline doesn't indicate you filed an I-129F. When did you file it?

Your timeline doesn't indicate you filed an I-129F. When did you file it?

Sorry, I modified my timeline becuase I'm not on K3 route anymore.

I filed my I-129 back in August 1. I filed it late because I waited for NOA1 like a good little boy.

They paired my 129 and 130 back in September. All is well and good except that they filed my petitions under August and didnt touch my I130 until recently.

On 1/3/2008 and 1/4/2208, both my petitions got touched. 130 approved and 129 unchanged.

I didnt know they closed my 129 until I received hard copy of my NOA2 for 130 and reliazed something fishy.

I'm new to VJ. Mailed I130 June 11, 2007, did not get I797 but learned of the WAC # from Boise field office. With the number I was able to register for email. CSC showed I797 was sent June 20 but we did not get. Requested another copy. I was told they were not able to mail receipt because CSC ran out of paper. June 29 Boise office said to send I129F with copy of email that showed I797 had been issued and assigned a WAC number. The I 129F reciept notice was form I797C issued July 11 from WSC said to check www.bscis for updates. Could not log on, thought www.bscis was a new web site under construction. Later learned this was a error and www.bscis was the old web site before uscis. 1st error I130 reciept notice I797 and 2nd error in I129F receipt notice. I realized USCIS has cerious problems, but telephone calls were useless. Receieved transfer CSC I797 dated July 11 issued July 24 stated that if premium processing had been requested call ##. Called the number but was told I129F do not qualify for premium processing only I129 job related application qualify. Tele to USCIS - told them wife does not want to work, i'm retiring and we want to travel. He said we would have hard time convincing them she does not want to work. More frustration, delays, and tele to USCIS. Went to Boise field office and asked to speak with sr officer. He did not know why I received notice about premium processing, but I130 would probably finish before I129F. August 2007 CSC processing time schedule dropped K-3 and only shows time for K-1. Looks like June USCIS made the change to drop K-3 but did not publish processing procedure change. Late October was told case should be adjudicated and call back in two weeks if I do not receive notice. 2 weeks later I called and they did not know what I was talking about. Boise office said I129F was still in WSC and would not be used, and I should probably call my congressman. The lady said their records showed I had called 7time and that was a record. I call because they make all the errors yet I'm punished because I want correction to their errors. November, came to Thailand for the winter, but would like to bring wife and myself back to the states in March or April to enjoy spring and summer in Idaho. Dec 19 received response from congressman w/ attach from cis my case was waiting more investigation. I have not received request for more info. I'm 24 days past the 180 processing time table. Any help you can give me would be appreciatied. I'm frustrated and need help so I joined VJ. Wish I had known about VJ earlier. :help:

Thanks. I'm trying to learn what can be learned from this. It actually sounds to me like your petitions weren't paired or at least their actions fit the unpaired model perfectly and are opposite their current policy for paired petitions. May I ask what makes you think they were paired, apart from the fact that they should have been?

Also, can you give us the wording on your I-130 NOA2? Does it mention NVC or does it say your relative is in the US and will adjust status?

If you actually filed an I-129F and not an I-129, then it sounds like they might have put your case in the I-129 queue by mistake. USCIS didn't stop doing K3 petitions, they just stopped processing them anywhere but CSC and VSC and changed their processing times display.

I agree K3 is much faster at NVC than 1-130, recently I have seen K3 is cleared from NVC in 3-5 weeks compare to I-130 takes between 3-4 months. The choice should be ours not their. If I am willing to pay an extra $1010 for the AOS then why does it bother USCIS. Shouldn't they me happy for the extra cash? LOL

If you actually filed an I-129F and not an I-129, then it sounds like they might have put your case in the I-129 queue by mistake. USCIS didn't stop doing K3 petitions, they just stopped processing them anywhere but CSC and VSC and changed their processing times display.
