Hi,

I'm preparing my AOS forms, and am just stuck at the I-864 form. I just need some advice as to what forms each person needs to fill out.

My husband is an undergraduate student and does not meet the income guidelines necessary to be my only sponsor. His father has agreed to be a joint sponsor for me, and to fill out any forms necessary. Does he need to fill out the I-864 or the I-864A form, or both? We do not live in the same house as his parents, but my husband is listed as a dependent on his dad's tax returns.

Also, since my husband must also fill out an I-864 form, how should he do this if he has basically little to no income (he is a student worker at a copy shop), and is getting most of his money from his parents at this time? Should he go ahead and fill the I-864 form out, knowing that the income he provides on the form will not meet the poverty guidelines?

He says all he has are some W2s and bank statements that show that he got paid.

Will this not matter once they see that a joint sponsor has filled out a form as well?

We'd appreciate any help so much!

US Citizen spouse MUST sponsor their immigrant spouse. So even if income is low he MUST still provide an I-864.

Father should fill out an I-864 also.

I-864A is only used in cases were a household member contributes a set amount of income as support.
