My UK based husband has the mistaken belief that if we do not file the I-751 IMMEDIATELY as soon as the 90 day window starts, he will not be able to work. He believes that he just isn't going to get his NOA if we file it at any point after the 90 day window starts, and that his April 19, 2008 (90 day window starts January 19) expiry date will come and he won't be able to work. I mean he is literally, and utterly, terrified.

Frankly, I don't have $545.00 to spend right now, and it will take me a few weeks to obtain it. (As in one month)

My questions are:

Do I really need to be worrying about this 90 day window thing? What if I can't file it till the middle of February?

Say we get it filed in the 90 day window, and the NOA doesn't come. How can we make it so that he can keep working?

If anybody comes up with how to do this and have him believe me, (ha ha ha) please e-mail me or respond here. You can also e-mail my husband at grimknight21@gmail.com.

What is an RFE?

RFE= request for further evidence.

You would receive an RFE letter in case the USCIS adjudicator looking at your case finds the evidence you have submitted along with your I751 not sufficient.

I suppose the most important question is what happens if the NOA does not arrive in time? How can he continue to work?

if he has to show physical proof of immigration status he can always get a I551 stamp at the local office, in case the NOA1 should have not arrived by then.

The greencard expiring doesn't mean you will lose PR status - as long as you apply for removal of conditions WITHIN the 90 days of greencard expiry you should be all set.

If your husband's SS card is already one without the "Work with DHS Authorization Only" notation, then he can present that unrestricted SS card and his DL for any re-verification that may arise.

If he still has the restricted SS card, he should to go the SSA office now, while his GC is still valid, and have his card changed to one without the restriction.

You should file as soon as your 90-day window starts. Your window is January 19-April 19. The sooner, the better. I think, USCIS will send you NOA-1 notice where they will mention that your husband's conditional residency is extended for one more year. So your husband can work, no problem.

It took 92 days for I-130 to get approved from the filing date

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

You can file anytime within the 90 day window. Usually people tend to file as early as they can. That way they get their NOA before the card expires. Also, filing as soon as you can helps in case there is a problem with your filing and it gets returned to you. That way you have time to fix it and re-file before the 90 day window closes.

1) filing in February is fine. (it is taking about 1 month to get NOA's) so he should receive his 1 year extension letter sometime in March.

question 2) if he doesn't receive the NOA (this would be unusual) and it's getting close to April 19th, he can make an infopass appointment at a local office, get the stamp, continue working etc and not have to worry.

and 3rd-ly), instead of fighting with you, the man should read up on the requirements, admit that you are right and be thankful he has a woman who is willing to research this stuff for him!!!! :whistle:^_^

Dear Sister, I do feel for you! My husband pressured me so much about that, his card expires on March 5th 2008. He wanted the papers at the VSC on dec. 5th 2007..I said no because he was not taking part of putting the information together and I needed to wait til I had the money on hands..I ended up mailing the packet on Jan 2nd 2008 and the VSC received it on Jan 4th 2008..Now we are waiting..

However I encourage you to mail it in February in case they need further evidence.

Please take spiderette advise, she is a real encouragement to this forum and she seems to be very

knowledgeable and firm about her information.

PS: Be strong sister you are doing a good thing and be very proud of yourself!
