if i have my dad and my uncle as my joint sponsor for cr1 visa? what do i need to do

my husband dont have tax return since apr 2006 to this date. his here with me in manila

im scared that my visa will be denied because of insufficient financial support from my main sponsor i need help? what can you suggest on this matter thanks. its highly appreciated. :crying::help: :help:

US Citizen Spouse MUST be primary sponsor for the spousal immigrant visa, the US citizen can use a Joint sponsor that is residing in the USA.

US citizen spouse must have maintained US Domicile, and must have been filing IRS returns. I-864 requires this, and US Citizen spouse MUST provide an I-864 to get the CR-1.

US Citizens may be exempt from paying tax on foreign income, but are not exempt from filing IRS returns.

Received Packet 4 here in the US (Interview Packet) = January 18, 2008

Case Left NVC Forwarded to USEM Manila = January 23, 2008

SLEC Medical = Jan 31 and Feb 1, 2008 (2 days)

USEM Manila Interview = February 20, 2008 @ 8:30am = DONE! (Status: 2 Months wait is over APPROVED)

CFO Guidance & Counseling = April 17, 2008

Visa in Hand = April 18, 2008 (Our Wedding Anniversary)

Arrival in the US and POE = April 23, 2008 JFK Intl. Airport New York City

Social Security Card = May 2, 2008

Green Card in Hand = August 18,2008

i will try to request thru fax IRS for tax transcripts. so if in case if he does not met the poverty guidelines. I can submit the requirements of my joint sponsor?

Both Spouse and Joint sponsor provide I-864s with attached financial evidence. You cannot just submit the Joint-sponsor's I-864 with out spouses I-864.

They also need a letter from the employer stating the salary and date of employment..

He will need to file a return for 2006 (due april of 2007). All U.S. citizens must file an a return unless their income is below a limit set by IRS. Any income earned in a foreign country is not taxed but must be reported.

He has to file an I-864 and with it, the 864 forms of any co-sponsors.

First trip 01-17-07

Married 02-05-07

What Service Center was filed at? Nebraska transferred to California

Please attach proof of the steps you have taken to establish domicile as described above.

as per lawyers advice:

if "SPOUSE" was required to file taxes for the most recent tax year then he will have to do so. He may be exempt on the basis of low income since he has been outside the US, but this is something you should speak to an accountant or tax professional about. Even if Mario does not meet the income requirements, you are correct that any US citizen or Permanent Resident, such as your father, may act as a co-sponsor, provided they can substantiate that they independently meet the income requirements.

I do not know why Mario having overstayed his visa in Manila would have to do with him replacing his US passport. I cannot however, advise on the issue of his visa overstay because that would be an issue of Philippines, and not American, immigration law.

THIS IS GETTING NOWHERE..ALL THE HARDWORK OF ME AND MY DAD. LORD HAVE MERCY. ON ME AND MY DAUGHTER.

You can request the tax transcripts just by calling the IRS and asking for them. They only take a couple weeks to arrive.

10/01/2007: Moved back to U.S.

02/13/2008: NOA-1 received (107 days)

07/02/2008: I-130 approved

07/22/2008: AOS filed including EAD and AP

07/25/2008: NOA-1s for all 3 received

08/20/2008: Biometrics appointment

08/22/2008: Received RFE for Affadivit of Support and Medical

10/21/2008: Submitted I-865W in lieu of co-sponsor and medical info to NSC

11/14/2008: online case status not updated since filing of AOS in July 2008

01/20/2009: Received another RFE for Affadavit of Support Info

02/02/2009: Responded to RFE with brand new AOS based on 2008 tax return (if that doesn't shut them up, dunno what will)

02/19/2009: EAD card received in mail (no updates on Online Case Status ever made)

02/23/2009: AP received (again, no online updates)

02/26/2009: Received interview appointment letter for 4/6/09

04/06/2009: AOS approved for unconditional GC

04/21/2009: GC received
