babies dual citizenship...?

got question again, my fiance asked me for original of birth certificate, he said that he may arrange dual citizenship for her n then i would not have to put her in visa. Just so u know, she was born here in czech, so she is czech citizen now. Is that possible? :wacko:

am not sure if the rules here are the same as Canada , but in my situation when my son was born in germany 20 years ago , his dad ( who was canadien millitary and stationd in germany ) was able to change my sons status to canadien citizen

so if the rules apply the same here in the states , yes its possible if your husband is on the childs birth cert ,

I believe the USC can register the foreign birth (up to a certain amount of days after birth, not exactly sure how many, maybe 60) and the baby is automatically a US Citizen. So your child would retain Czech citizenship, and have the USC as well.

Depends. How old is the child and also I assume the U.S. citizen is the Father?

If the father meets the legal requirements in the INA for the child to receive citizenship from his parentage, then it is possible. It also depends if the father is married to you or not. If not, the father will be required to legitimate the child (meaning sign a legal agreement to provide support for the child) and may be required to have a paternity test to prove parentage..

You need to get this taken care of since the Embassy will not issue a K visa to the child if there are questions regarding parentage since US Citizens no matter their age are required to enter the US as US Citizens.

He would have to check with the US Embassy in Prague for their requirements to issue a Consular Report of Birth Abroad. Most likely, you and him would have to appear at the Embassy in person to file.

But this does need to be taken care of before you get your visa.

The information you need is here.. Prague does require both of you to file in person and as it is stated, additional paperwork will be required since you are not married.

A consular report of birth abroad is definitely one way to do it. Another is just to apply for a US passport for the baby. That can be done in the US. It may be cheaper and/or simpler, but I'm not in a position to say which route is easier.

A note to remember, you're not "applying for dual citizenship". You are asking the US government to give you a document that shows that they recognize the US citizenship which US law says she has automatically held since birth, as a result of her being born of a US Citizen parent who has been a US resident for the required time. Whether she also happens to hold Czech citizenship is not a matter of interest to the US government. You're not applying for any new citizenship or status for the baby.

See this Travel.state.gov website for instructions on how to apply for a passport for your baby:

1. If you claim citizenship through birth abroad to one U.S. citizen parent:

Foreign birth certificate,

Proof of citizenship of your U.S. citizen parent, AND

An affidavit of your U.S. citizen parent showing all periods and places of residence or physical presence in the United States and abroad before your birth.

04 Apr, 2004: Got married

05 Apr, 2004: I-130 Sent to CSC

13 Apr, 2004: I-130 NOA 1

19 Apr, 2004: I-129F Sent to MSC

29 Apr, 2004: I-129F NOA 1

13 Aug, 2004: I-130 Approved by CSC

28 Dec, 2004: I-130 Case Complete at NVC

18 Jan, 2005: Got the visa approved in Caracas

22 Jan, 2005: Flew home together! CCS->MIA->SFO

25 May, 2005: I-129F finally approved! We won't pursue it.

8 June, 2006: Our baby girl is born!

24 Oct, 2006: Window for filing I-751 opens

25 Oct, 2006: I-751 mailed to CSC

18 Nov, 2006: I-751 NOA1 received from CSC

30 Nov, 2006: I-751 Biometrics taken

05 Apr, 2007: I-751 approved, card production ordered

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

30 May, 2008: Naturalization interview, passed the test!

17 June, 2008: Naturalization oath notice mailed

15 July, 2008: Naturalization oath ceremony!

16 July, 2008: Registered to vote and applied for US passport

26 July, 2008: US Passport arrived.
