Co-Sponsor - a few questions

Hi,

Please can someone help me with this.

I am currently preparing my I-134, and I have some questions on how to proceed.

My fiance is currently in his first year of law school after having worked for a couple of years. He relies on loan at the moment as he has spent his savings but will be working at a law firm this summer. As at the moment his salary and savings (he has no property) would not be sufficient to be a sponsor, his dad has agreed to be a co-sponsor.

My questions are these-

1. Does my fiance need to fill out a 1-134? And should he give his bank records, tax returns, letters confirming his loans for last few years?

2. Is there any form to fill out for the co-sponsor in addition to the I-134?

3. At the end of the I-134 is a section called "Oath or affirmation of sponsor". How do I tell me fiance and his dad to fill where it says "My commission expires on..."? And does this document need to be notarized?

1) both your fiance and his dad need to fill out the 134 if he is co-sponsering. and both copies must be notarized

2) No (unless your consulate requires you to fill out an OF-167) some consulates do require it. So you'll have to find out if your consulate does or not

3) Yes for notarization, im not sure with the commission expiration part though, sorry

Donna, the answer to question 3 from you is for the Notary Public to fill out where it says "My commission expires on..."when it is being notarized. ok? remember 1 wrong mistake might lead to a RFE(or a delay) be careful .. we have to wait long enough any way,.. even without a RFE. ....

It is usually standard for a public notary to have a stamp that tells their name and when their comission expires. The notary should know when their comission expires and it is a good idea it's on the notarized form.

As for " my commission expires on" : that is the Notary person's commission expiration date (in other words when that person is no longer a Notary)

I was a Notary Public for my state back in the day ...lol.....

The petitioner always must complete the I-134 (no matter what) - he should include any documents needed to support the information given on the form.

2. Is there any form to fill out for the co-sponsor in addition to the I-134?

The co-sponsor completes the same (I-134) and must supply (as said above) any documents needed to support the information given on the form.

3. At the end of the I-134 is a section called "Oath or affirmation of sponsor". How do I tell me fiance and his dad to fill where it says "My commission expires on..."? And does this document need to be notarized?

As others have said - this is for the Notary Public to complete. The document (I-134) must be signed in the presence of this (official) Notary Public who also signs, then stamps the document with an official seal.

Thank you for your repsonses.

I have another question about the I-134 - do any W2's need to be the original or will a copy suffice?

I am asking my fiance and my father who will be our co-sponsor to provide:

1) W2 for both for 2004, 2005 and 2006

2) My future-father in law to provide a letter from his employer and his bank confirming salary and savings

3) My fiance who is in law school to provide a letter from his law school confirming his attendance, and something confirming the loans he has taken this year. He has worked for the last 2 years so has W2 filled showing his income from then.

Will this be sufficient to cover the requirments?
