Married in United States, Planning to File DCF in South Africa Wednesday the 10th of May

I guess reading the requirements for filing in SA it sounds like he can do what he is saying he wants to do.

I would still contact the embassy though. Even though in KL you have to be physicaly married in Malaysia

to file DCF and I read that on the web page i still called the embassy and verified it....

Typically it's better to have the USC call/contact the Consulate but I don't know what would happen in their case, where she has already called.

Hi,

I am married to a South African as well. I had researched quite a bit before trying to decide the best route to get him over here the quickiest. You cannot do DCF in South Africa if you are not residing there or studying or working in some sort of fashion, Even though your passport is stamped as temporary resident it is catogorized as a visitor, when going over there to visit. It will not work for DCF even if you stay the maximum of three months. I have emailed and called and spoken directly to the US Embassy in South africa

Here is part of a response from Leslie Meeker the CIS officer in charge

"American citizens that are based in South Africa for extended periods of time – for instance because they are working in SA or going to school in SA – can file immigrant visa petitions at the US consulate in Johannesburg. " otherwise she states you have to file in the US.

Believe me I was crushed as well. Sorry to burst any bubbles but it should be known. Good luck

We were told we could not DCF in Taiwan unless we got married there. Why would SA be any different, it is still the Department of State that runs the embassy where you apply.

Since work was slow I copied and pasted this page from the US embassy in SA.

For an American citizen, applying to obtain immigrant status for his/her foreign spouse, child, parent or sibling

The Petitioner and Beneficiary must both be present and submit their passports for identification purposes. One copy of each of the required supporting documents must accompany the petition. Forms are also available at the consulates.

Documentation needed for filing on behalf of a spouse:

Completed I-130 form from the petitioner.

Completed Form G-325A (Biographic Information) from both the beneficiary and the petitioner

Valid U.S. passport for the petitioner and a valid passport for the beneficiary.

The original full, unabridged Marriage Certificate. If you were married in South Africa you must apply for this specifically. We can provide an application form that should be submitted to your nearest S.A. Dept of Home Affairs office. Final decree(s) of divorce or death certificate showing termination of ALL previous marriages.

A passport size photo of each spouse, in either color or black and white.

A filing fee of $185 (Rand or U.S. $'s) payable in CASH or bank/traveler's check made out to U.S. Disbursing Officer

Actually, I was in South Africa on a visitors visa and was able to file for DCF. I amnot sure if it was just a stroke of luck or what, but they did allow it. Yippy...interview is coming up!!!!

09/10/05 Sara returns to California

11/20/05 Charlie arrives in California on a student work visa

02/20/06 Charlie goes back to South Africa

06/18/06 Sara returned to South Africa

08/29/06 We got married!!!

09/15/06 We received our long form marriage certificate

09/16/06 We send in paperwork for police clearance

09/18/06 We file DCF in Cape Town Embassy

09/20/06 Sara returns to California

11/01/06 Our DCF petition (I-130) is approved

11/13/06 We receive our instructions online

11/14/06 We email the checklist back

11/15/06 We receive our appointment via email

11/22/06 Interview and visa granted!!!

11/27/06 Charlie leaves South Africa??
