My wife went in for her CR-1 interview on Friday and encountered a very rude and impolite Immigration Officer. Perhaps he was having a bad day because apparently he was giving everyone there a hard time. After reviewing our case he asked to see my W-2 for 2006. My wife had my IRS issued Tax Return Transcripts for 2006, but he didn't want to see that at all! I don't get it. It contains the same information that you would find on the W-2. He said wanted to make sure that my wife won't become a public charge. I make well over the poverty line, my wife provided my employment letter, my paychecks, and my bank statements. Still he wanted to see the 2006 W-2.

So over the weekend, I scanned and emailed my wife my W-2 for 2004, 2005, and 2006, along with my State and Federal returns (540 and 1040). I didn't want to give this guy any more excuses.

On Monday, she went back to hand over my tax info. This time she got a different Immigration Officer. This one was much nicer, and just asked a few questions. Didn't ask to see any W-2 at all. So my wife got approved and they will be sending her the CR-1 visa in 2-3 days.

I guess getting your CR-1 approved depends on the mood of the Immigration Officer as well, not just the paperwork. Hope the other angry officer doesn't find out and track us down to take the CR-1 back!

You may want to scan the page in the I-864 directions that clearly states that transcripts are acceptable in place of (1040/W2/1099) Or have wife print the instructions out and attach to your (1040/W2/1099) return.

25. Federal Income Tax Information.

If you provide a photocopy of your tax return(s), you must include a copy of each and every Form W-2 and Form 1099that relates to your return(s). Do not include copies of these Forms if you provide an IRS transcript of your return(s) rather than a photocopy.
