wanted to file EAD first before filing AOS, help please

Hello everyone! i am having a problem with regards to applying my employment authorization, is anyone out there who has the same situation as mine?

I wanted to file the EAD first before applying my AOS:

here is my situation: my I-94 is already expired and i didn't get a chance to file my SS# before my visa expire. I already got married on Dec. 5, 2007 and the next thing to file now is my adjusting my status but since the fee for AOS is so much and we can't afford yet to pay the whole $1010 and we need to save some more for that, now my question is we wanted to apply my Employment Authorization to the USCIS so i can work. How should i apply for it, where and how much willit cost? and another question is if i apply EAD today, how much will it cost for the AP and adjustment of status?

unfortunately you can't do it that way. any EAD application must be based on your pending application for adjustment under © (9)

You can not apply for an EAD before AOS unless you came on a K3 visa..... as you say you got married in Dec I assume you came on a K1.... you can only file for EAD based on your application for AOS....

Unfortunately, you can't file the EAD without filing for the AOS. The EAD is granted based upon a valid immigration status - either as a K-1 or as an AOS applicant. When your I-94 expired your status in the US also expired. You need to submit the AOS application along with the EAD application in order to receive an EAD. Once you file the AOS your status becomes AOS applicant, and the EAD is based upon having an AOS application on file - there is no other basis upon which they can grant you an EAD. Save up as quickly as you can so you can get the AOS and EAD applications filed. Fortunately there is no separate fee for filing for an EAD - it is included in the AOS price. Even still, once you file it will be at least a good 3 months before you will receive the EAD. Good luck.

You can not apply for an EAD before AOS unless you came on a K3 visa..... as you say you got married in Dec I assume you came on a K1.... you can only file for EAD based on your application for AOS....

Yes i came here as a K1, does it mean i can only apply for my EAD if i file my AOS? i thought i can do it separately..

You can only file for EAD along with or after you apply for AOS...... your EAD will be based on your pending claim for AOS....

Correct :thumbs: a K-3 can do it separately, a K-1 cannot.

Thank you so much for you reply, now i am totally cleared with whats bothering me and all my questions are answered.
