do i need to include picts for I751? help!!!

hi all! i have few questions regarding applying for removing conditions.

1. Do i need to submit photo's of me & my husband? as an evidence of relationship?

2. I read before that submitting the application, it should not be stapled or use paper clip the documents. is this true? so what kind of stuff do i need to use to keep my documents in order?

3. Do i need to make a cover letter?

2) Not a good idea to staple.

In preparing your packet, please take note of the following:
  • Do not use binders or folders that cannot be easily disassembled.

  • Use ACCO fasteners to hold together thick or bulky applications or petitions. Two-hole punching the top of the material for easy placement in the file is appreciated.

  • The use of tabs assist in locating items listed as attachments. The tabs should be placed on the bottom and not the side for ease in filing.

  • Avoid using heavy-duty staples; instead use ACCO fasteners or heavy clips.

  • Avoid submitting originals unless specifically required. Avoid submitting oversized documentation when possible.

Hi yu & dan. pls. clarify for me. Its been a long time i have not done or do some reading here in vj. as far as i know i need to file a removing conditions, my green card will expire next month. they approve my gc feb 2006. i am not qualified ( till 2009)yet to get a naturalization since the counting of 3 yrs. is froom the time they approve your gc. unless im worng with this. if someone could verify this. i would appreciate it.

indeed, you are applying to remove conditions, not naturalization.

I am SO SORRY to read about your husband's passing - I feel for you sister and have you in my prayers. I believe in this case the process is the same but you might need to submit extra documetnation (not necessarily photographs), plus obviously your baby's birth certificate, and your husband's death certificate.

Again, I wish you only the very best and you'll be in my prayers.

Thanks len. i already have his death cert & my daughter's birth cert. too. I already have the affidavits, some of our bills. not all our bills were in our name, its either his or mine. so i dont know what else i need to submit. we dont have much property together since i just move here 3 yrs ago then he got sick. thanks for the prayers again & i hope they (USCIS) won't be too hard on me. I already have enough with them since i move here. take care

indeed, you are applying to remove conditions, not naturalization.

I just noticed that, on a side note you did not have to wait until 90 days before conditional green-card expiration to file I-751, you could have filed as soon as you had death cert, and filed a waiver to the joint filing requirement.

I believe the rule for naturalization is 3 years if married to a US Citizen, but is 5 years if not married to a US Citizen, in your case I believe it is 5 years from Feb 06 so should be Feb 2011.

yes it is 3 yrs for american citizen & 5 yrs for non american spouse. my husband's an american citizen, so i will have hopefully my naturalization next year.

What I am trying to say you need to be married to a US Citizen, and was trying to be delicate, your hubby passed away last summer, so unless you married another US citizen, you are not considered married to a US Citizen for the 3 year requirement.

sorry i didn't get it right away.

i thought that's why i have to file to waive the joint filing requirement due to the death. my husband called the 800 number when he was sick & ask them about it, they said that i have to file to waive the joint filing. dont know how reliable they are. but im hoping i will still be able to file for naturalization.

and additional info. he was never sick or diagnose with cancer before we met. so its not that we know it even before. he was just diagnosed on 2006 & i can pull out medical records for that if that help in the long run. any input will be highly appreciated.
