I just got married and my wife is a foreigner. I am applying for adjust for status for her... and got some questions... please help me out!!!

1. From I-130 instruction, page 2, it states that "A completed and signed Form G-325A, BiographicInformation, for you and a Form G-325A for yourhusband or wife. Except for your name and signatureyou do not have to repeat on the Form G-325A theinformation given on your Form I-130 petition." --> so what exactly I have to provide on G-325A then??? all information or just name and signature???

2. On form I-864, page 3, part 5 (sponsor's household size), i am sponsoring my wife, so 21(a) =1, and 21(B) is 1 too (for myself). what about 21©? I am married, shouldn't i put 1 on 21© as well? but actually our household size is only 2. What should I do????

3. On I-485 form, part 2, i am not sure which option i should choose for an adjustment to permanet resident status?

I can help answer your first 2 questions:

1) Just fill each form completely; don't make things more difficult than instructions cause them to be. It will ensure you've made no errors in leaving out important information.

2) On page 3 of Form I-864, Part 5, It says Your Household Size "DO NOT COUNT ANYONE TWICE" I agree, the form is confusing and doesn't explain what to do. Reading the instructions for part 5 gives a clue how to answer. Put 0 for 21c since your spouse has already been counted in 21a. They'll understand!

If you are fillingG325 on the computer (highly advisable) you do not have to fill in all four pages. Once you fill in the information on one page it automatically copies into the other three pages. All you have to do is sign and date each page at the bottom.

On the I864 you should put "0" in the second place it asks about your wife. Do not count her twice. I believe it says that in the instructions.

On the 485, I'm not sure what you would put because you have no info in your timeline or profile to say how your wife came to be here. Did you file a K1 visa, K3, CR1? Or did she come on another visa and you got married?

Please help me......... I asked this question before ... sorry

I am the USC and on I-325-G it asks for Husband or wife Family name ( my family name), but it says to provide maiden name. I use my ex husband's family name as my family name, but there is no place to write it. What should I do? The example form provided does not apply to cases like mine, and I wish there was an example where the beneficiary is a man who is married to a woman who uses her ex husband's family name.

Also, I believe that the example form should be corrected where it says husband family name it should say "smith" and where it says first name it should be "john"

Another question

Form 485. The line where it says "Address- C/O" do we leave it blank?

That's a really good question that I don't know the answer to. As far as the Address- C/O question, you can leave it blank if you do not need for your mail to be delivered in care of someone else.

I don't know how OPT works, so hopefully someone will come along that does and can answer your question.

How about it, is there anyone out there that knows about OPT and can answer the question about what to select on Part 2 of the I485, as well as whether it would be a problem to file for AOS now?
