hello people.. happy new year. im a new member here. im so glad that there are forums like this where you can guide people like me that needs guidelines in applying for adjustment of status. i got married to my USC fiance last june 2007. in july 2007 we filed the form I-130 and got the I-797 in August of the same year and until now were still waiting for approval of that petition. i didnt know that a fiance visa can get a social security and temporary EAD. i only found out here in your forum last month that i am eligible to get that since i have a fiance visa. now my fiance visa and I-94 has expired. my quetion is, could i still get a work permit and social security even if my fiance visa and I-94 has expired? or should i still have to wait for the approval of I-130 before i proceed to get the work permit/social security and I-485? i hope you could help me with my question because i really want to work. also if anybody could give me some guidelines and requirements needed in appyling a work permit and I-485 or a web site were i could find it, please let me know, i would really appreciate it. thanks a lot guys. :thumbs:

Please fill in information in your profile and timeline because it makes it easier to know what you're asking about. The answer to your question will depend on what visa was filed for you.

Your post is very confusing..... you say you came on a K1 but you go on to say you have filed a I-130.... If you came on a K1 then you do not need to file a I-130 unless you did not get married within the 90 days, then you would file for AOS and I-130 together...

It would be helpful if you completed your timeline or gave us more information about what exactly you have filed for and when....

actually we asked the assistance from the same person who filed my I-129F. he said that all we need to do is to wait for the approval of I-130. now im getting confuse because ive seen the step by step proces and seen some members that filed I-130,AOS,EAD all together. please help me what should i do next because my K1 visa has expired so as my I-94. if we are going to file the AOS and working permit now is it ok even if it was expired? thank you so much for your help.. As you came to the US on a K1 visa and married within the 90 days, you should have filed the I-485 along with AP and EAD. You did not need to file I-130. That is for those who are adjusting from any other visa. I would withdraw the I-130 application as it is unnecessary and file for AOS, EAD and AP as soon as you can.

thanks a lot CB82. :) that answers my question. ill discuss it to my husband and proceed in filing I-485,AP,EAD. if we dont withdraw the I-130 and proceed in filing AOS would it affect that? and also where can we send the forms of petition? where living in simi valley. do have e exact address where we can mail our forms? thank you so much for your help.. this forum really help me and other people that has questions with the same as mine..thank you so much and more power :)

Fill out the AOS, EAD and AP forms and mail them all in the same packet (along with the $1010 payment) to:

These addresses are also on the instructions page of the I-485 (just in case i typed something wrong). It doesn't matter where you live when filing AOS. All AOS applications have to go to Chicago and then they are forwarded on to MSC. After that it may get transferred to CSC or on to your local office where you will be interviewed.

I personally don't know what will happen if you don't withdraw the I-130 application. If you live close to your local USCIS field office, you might want to make an info-pass appointment and ask there. Don't call the USCIS mis-informaiton line as they are useless.
