Alright, if this is true, then wonderful news...but how do I know it's true?

I was reading up on this website: USImmigration.visapro.com and it states the following:

You can remain in the U.S. while you wait for the approval of the Form I-130 and are able to apply for lawful permanent residence status (adjustment of status), or for a green card, instead of having to wait outside the U.S. as the law previously required.

IS THIS TRUE?!?!?! :help:

Would an immigration lawyer website state you would be able to do that?

Just questioning...personally that's a little bit of hope for me...but if it's not true...back to square 1

Where is Rebecca - I dont understand this........I can go search the laws but have not heard of this unless the SO is already here and did not have the intent of marriage when coming over on another type of ViSA. hmmm.....worded so very nicely that little article, but if that was true, all of us would be booking tickets for our SO's right now....well at least 200 that I know of.

It sound weird when i read this paragraph....me thinks they are selling services that you cant really do..but dont know for sure...

If you enter the US with a visa such as a H visa or a student visa, then you happen to meet an American and get married you can use that process with little difficulty.

It's much more complicated for people who enter under the VWP or Canadians under the pretense of a visit.

You have to be able to prove that when you entered the US, you had no immigrant intent.

It's much more complicated for people who enter under the VWP or Canadians under the pretense of a visit.

You have to be able to prove that when you entered the US, you had no immigrant intent.

Aye it is misleading quote to say the least........ok back to Deal or No Deal.

I think it's loosely worded for good reason, as you said they are trying to sell you something.

Let's face it, we all know there are PLENTY of lawyers that will tell people who DO intent to get married to go this route by entering the US 'pretending' to visit then decide to get married after visiting for 60 days.

Because, after all they still get paid even if your 130/AOS gets denied and your sent packing.

I have an OPT visa that I'm not really using, but it's valid until June 2008. If I went there and got married and stayed..would they consider that fraud? I'm working here in Canada but continuously searching for work in the U.S.

It's a shame they had to write that.

Now I feel like I'm back in square one. Any advice on where to start?!?!? If I marry my American man soon...I should apply for K3 correct? I see all kinds of different timelines so I'm a bit worried as to which would be the best way to go! Thanks everyone :blush:

I am not in the US quite yet my friend, my passport with visa won't be mailed out till Monday.

God willing I will be there by Thursday or Friday.

Just questioning...personally that's a little bit of hope for me...but if it's not true...back to square 1

If you enter the US with a visa such as a H visa or a student visa, then you happen to meet an American and get married you can use that process with little difficulty.

It's much more complicated for people who enter under the VWP or Canadians under the pretense of a visit.

You have to be able to prove that when you entered the US, you had no immigrant intent.

I have an OPT visa that I'm not really using, but it's valid until June 2008. If I went there and got married and stayed..would they consider that fraud? I'm working here in Canada but continuously searching for work in the U.S.

It's a shame they had to write that.

Now I feel like I'm back in square one. Any advice on where to start?!?!? If I marry my American man soon...I should apply for K3 correct? I see all kinds of different timelines so I'm a bit worried as to which would be the best way to go! Thanks everyone :blush:

I am not quite sure what that visa is and what the conditions of it are.

But I imagine that if you entered under the expressed purpose for the use of that visa, then happened to marry your honey, that would be ok. I think in your case, it would be worth contacting a lawyer for.

While the paperwork is ongoing you can visit the USA (with POE officers approval) and as a Cdn you can stay up to 6 months a yr in the usa (with approval) The k3 and cr-1 are taking close to a yr to complete from start to finish!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

many Cdns and others visit while the visa process is ongoing. I traveled every month to DC while the process was ongoing. Longest I spent was 3 weeks. Cdns can spend 6 months a year. Not sure when the year starts and stops (is it jan 01 to dec 31?????)

Please be careful with your wording, as Canadians can visit for a maximum of of 180 days. Some 6 months stretches can add up to 182 days so it's important to know the difference.

Sadly, there is no guarantee that you will allowed to visit.

As a general rule, most Agents tend to be more accommodating if you are planning a short visit, that there is a 6 weeks span or more between visits and that you have strong ties to Canada.

I am willing to wager that if you told the CBP guard that you are 'visiting' your spouse for a 180 days while you are in the immigration process, that they will not let you enter. With a visit that long, you are essentially living in the US while awaiting your visa approval, where as the letter of the law states that you are to remain in your home country.
