My question is that I have been known in the uk as a certain name since I was 3 but my birth certificate shows my original name which officially has never been changed ( all records such as NI, Passport, taxes etc show my known as name )

If I keep my name as is when I get married will my SO need to change her name to my birth surname or to the one I am known as now?

If it is my original one then I will get it changed by Deedpoll as no way am I going to go back to being called Chrismas :(

Either way, I don't think legally changing your name in the US at any point in time is a painful task. This would be worth checking with the SSA about.

There must be some legal basis for your known as name being on your ID and Passport. Your birth certificate will need to presented at interview along with any basis for your use of another name on your passport and visa application. As for the marriage, your spous can keep her name or change it to yours. So, which name IS your name?

To be honest I have not got a clue what my name is!!!!!!! I am pretty sure that it has never officially been changed but in England you can get your records etc changed if you have been known as someone else for a certain peroid of time. The only thing in my birth name is my birth certificate, everything and I mean everything else is in my surname I go by.

So which one do you think is my surname? Very confusing isn't it!!!

John Jones can't just bring Bill Smith's birth certificate and say, "This is my birth certificate.". Bill will need some documentation that John got his ID and records changed to Bill Smith, so you'll need those records or some document from a government source that attests that Bill Smith's birth name was John Jones. I don't know where you're going to find it but you can find it now or find it after your visa is denied.

Your answers about your name change and passport are going to come from authorities in England. This is a serious matter.

Thank you. Just for info a deed poll is an official way for you to change your name legally within the UK if that helps.

Not quite the same situation but, after I left my first husband (but nine months prior to final divorce papers), I changed my surname back to my birth surname by deed poll and also added an additional middle name that I have been known by since I was a child. When Mark asked me to send him documentation I included a certified copy of this deed poll with the other evidence even though my passport, birth certificate, and even my final divorce papers all show my birth surname. The deed poll service is quick, easy, and relatively cheap... and if you don't have any other official record of the change this might be a good back-up to have in-hand. Better to have it and not need it!

Not quite the same situation but, after I left my first husband (but nine months prior to final divorce papers), I changed my surname back to my birth surname by deed poll and also added an additional middle name that I have been known by since I was a child. When Mark asked me to send him documentation I included a certified copy of this deed poll with the other evidence even though my passport, birth certificate, and even my final divorce papers all show my birth surname. The deed poll service is quick, easy, and relatively cheap... and if you don't have any other official record of the change this might be a good back-up to have in-hand. Better to have it and not need it!

What my Fiance is trying to say or ask I believe is....

Should he use his birth surname or the name on all of his relevant papers (passport, bank statements, leases, plane tickets etc..of course excluding his birth certificate) on all of our paperwork for the K1 process and just list His birth surname as other names known?

SHould he have his name officially changed by deed poll (legal way to change name in UK , recognized by all government agencies) would it matter that it was just done know and not when he was little?

What other thing should we include to explain the name change? We thought a notorized letter from his mother saying that David went by his stepfathers last name since age of 5

his doctor that all medical records have been in that name as well

he has nothing with his birth surname except his birth certificate so it seems logically he should use the name he has gone by for the past 29 years. but we do not want a RFE or worse visa refusal......

David and I met online December of 2006 and spent a year getting to know each other online and with visits! He proposed to me July 2007 onstage at my Favorite bands (candlebox) concert in Florida .We found out we were expecting a child January 31st sadly due to an ectopic pregnancy we lost the baby and almost lost me as well on February 8th. We then decided to get married if my long and drawn out divorce finalized before David was due to go back on April 13th

Divorced finalized March 20th

3/30/2008 MARRIED !!!!

4/11/2008 I 130 , I 485, 1765 and I131 Mailed to Chicago Lockbox

4/21/2008 first NOA for everything

5/17/2008 RFE for Affidavit of support

5/20/2008 mailed in response to RFE

5/22/2008 Biometrics

6/10/2008 EAD Card production ordered!!!!

6/10/2008 I131 Approved YAY we can visit England again!! (nobody from there could make our short notice wedding)

I've been trying to make it as simple as possible. He can't use his birth name unless he changes all his ID to that name.

He can't submit a birth certificate in another name without some official government paperwork indicating both names are the same person.

So, yes, I think it is critical that he have his name officially changed by deed poll or whatever is the approppriate UK government agency. What is missing from the equation is how in the world. Backing that up with an affidavit from his mother would be good too.

Agreed - it is VITAL to have paperwork explaining any changes to name use. So any time you are required to show the birth certificate you will need to explain. Think of it this way, it's similar to when you first get married as a woman and have to take both your birth certificate and marriage certificate everywhere for a while to prove identity.

For the visa application you should use the name he is known by since everything except his birth certificate carries this name BUT get the name legally changed! Put the original surname in the other names used box and enclose the deed poll with a typed sheet explaining the circumstances and that he has obtained a legal change now to avoid any future problems.

I cited my circumstances since in the UK many women just return to using their maiden name without officially changing it back since there is no real legal requirement provided that you inform the tax office, etc. I changed mine because I needed to apply for a passport and I seem to recall it asked on the forms for documented evidence for that kind of change - but probably only since age 16.

You merely need to provide the details and state that as the change was made while he was a child that it never occurred to him to enquire as to whether any legal documentation had been issued to document the change until now.

Query though - was the name changed as part of an adoption process by the stepfather? Because that paperwork would probably work in much the same way as a marriage certificate, removing the need for a change by deed poll.

No his name was never officially changes he was not adopted by his stepfather but his sister and him have went by that last name since before they even went to school.

I don't know the UK law but in the US a person can use any name they wish as long as they aren't attempting to defraud anybody while doing so. One might even get a drivers license in a step-father's name but when they turn 18, they must go back to their legal name unless they've been adopted or legally changed their name. Anyway, it sounds like you have a workable solution.
