hi everybody...so im in this situation...i entered us on visitor visa 4years ago, i was gonna arranged work visa, but cuz of lawyer sayin all the time somethin diferent didnt happened...i stayed in us illegaly then n worked illegaly as well. I met my fiance two years ago, but later down the road i got pregnant so i traveled back home to be with my family when baby will come. Now we r tryin to get me back to us on K1. PPL from forum told me that since i worked n lived in us ilegaly i need to file what is called Waiver first....do you have experience with this? is it form I-160? how does this work? :wacko:

You don't file a waiver first. Because of your overstay your visa will be refused at your Embassy interview and it is then you need to file your waiver.

Hello! As mentioned before, you will have to file for the visa first, you will be denied at your interview due to your illegal presence in the US, and then you will be required to file an I-601 waiver. Your SO will need to prepare a hardship letter showing why it would be a hardship for him to relocate to your country and why it would be a hardship for him to remain in the US without you. Usually waivers take 6 - 12 months to adjudicate, so be prepared for a long road ahead. Good luck!!!

Summer 2003- We met (in the U.S.) and began dating.

Summer 2004- My SO moved back to Egypt; I spent a month there with him.

December 2004- SO called my parents and got permission to ask for my hand in marriage; They said yes, of course!

Christmas 2004- I traveled back to Egypt and accepted his proposal while we were on the sands by the Red Sea...

July 2005- Got married; I moved to Egypt

Nov. 2005- Began the immigration process!!!

July 2006- Hubby's immigrant "interview" at embassy in Cairo was no interview- told to file waiver for past visa overstay

Aug. 2006- Waiver sent from Cairo to Athens

April 2007- Waiver transferred from Athens to Rome

August 2007 - I moved back to U.S. from Egypt in anticipation of waiver approval (just had a feeling!!) and to continue my career because my 2 year work contract had expired in Cairo and my wondeful job was still here waiting.

Nov. 2007- Waiver approved... thank the good Lord!!!!

Dec. 2007- Interview- but not really an interview- just had to sign the updated DS230; Told to expect visa in 2 weeks.

Jan. 2008 - Visa in hand! It actually did arrive in 2 and a half weeks... Hubby back in our home 2 days later!!!

Feb. 2008- Green Card arrives

Today and everyday- Loving life back in our home, having a blast, enjoying every moment with family and friends, praying for all of you still waiting! Miracles DO happen!!!

well not a good news....6-12mths...but definitelly helpful, thanks!

oh yeah, n so if they approve my I-160 i will automaticly get K1? or will i need to aply again since it will b denied?

After the I-601 is approved you will have to resubmit some parts of the application at their request, but after those documents are submitted you would be granted the visa.

There is a special section dedicated to the I-601 waiver on www.immigrate2us.net. It gives examples of the Hardship Packet and letter that you will need to submit. It would be a good idea to look around over there too.
