PLEASE HELP!- After married, wife left U.S. (problems back home, but not REAL emergency, though) B-4 we applied 4 AOS. Was a rash decision.

Timeline

HELP!!!- After we were married here in the U.S., my wife left the country on 12/29, BEFORE we applied for her AOS, to attend to "problems" back home. There was no REAL medical-like emergency, though. Of course she was on a single entry K-1 visa. Although I educated her about the consequences of leaving (such as the fact that we would probably have to go through THE WHOLE K-3 visa process), she was in panic mode and left anyway. This was clearly a rash decision that I protested vehemently, which she now SEVERELY regrets. Panic is over, and she is stuck back in Russia separated from me AGAIN, and we are both miserable about it. We on this list all know that the K-3 visa process will take at least as long as the original K-1 did. Does ANYONE know of any way to get USCIS to renew visa for another entry WITHOUT having to go through the ENTIRE K-3 process???

ANYONE with ANY ideas, please respond!!!

You will have to file for her again -- this time as your spouse.

Timeline

You will be filing for a new visa this time a CR-1 or K-3 visa. I would be doing the CR-1 because it results in a green-card, and for most countries CR-1 is not much longer to get than K-3.

At least you did not file for AOS and pay out the $1010 like this one did.

You need to file CR-1 for her here in the US, she has to stay in her home country while the new visa is applied for, and when approved she will be free to return to the US, there is no other way round it.

March 21, 2007 - I-129F NOA2

October 17, 2007 - K1 interview - approved

October 19, 2007 - K1 arrived in mail

October 21, 2007 - US entry

I did see a reply on a thread once that suggested that the embassy MIGHT be able and willing to re-issue the visa if it's still within the 6-month-from-issuance timeframe. If they can, I wouldn't count on them doing it, and even if they did, they'd want good proof of an emergency situation. I think you will have to start over again with a K-3, but won't hurt anything to contact the embassy and ask if they will re-issue the K-1.

There have been a few instances where someone entered on a K-1, left because of an emergency before they were married, applied at the Consulate to have the K-1 re-activated, and were successful, but the K-1s were re-activated for only the same amount of time as was on the original K-1. This is only possible while the beneficiary is unmarried. Once they are married they can no longer have a K-1 re-activated as they have already used it for its purpose - to enter and to marry within 90 days. The OP needs to apply for a K-3 or a CR-1 visa - a spousal visa - for his wife to be allowed to return to the US.

Only if still-unmarried, and less than 90 days from first K-1 entry, the OP is married, K-1 is for fiancees only.

And again I don't recommend the K-3, CR-1 is an IMMIGRANT visa that results in a green-card, K-3 needs adjustment of status, and in most cases CR-1 only takes slightly longer to get.
