Hello all

My husband has his permanent residency thanks to 2 long years of sacrifice on my part. He left me 5 months ago (after being in the country for all of 7 months) and I am days away from giving birth. Can you believe this guy???

Long story short I recently uncovered chats between him and a woman from his country in which they discuss their upcoming wedding. Apparently he is planning to travel there this summer and marry her.

Oh, here is the nice part: he does not have any interest in divorcing me, I have asked him several times. I'm assuming he is afraid divorcing me might make him look suspicious for fraud or otherwise jeopadize his green card. And I'm not planning on advising him about his rights ..

I really want to get his residency revoked somehow, now it seems has plans to commit bigamy. Does anyone know how I can prove this? --Assuming he goes through with it.

You can let the USCIS know what happened, but its up to them at this point to do anything about it. It appears that he was using you for visa fraud. Depending on your state, you may be able to get a divorce anyway.

me i would let him go ahead and get married to her then bring him up on bigamy charges and then turn him into the uscis. give him enough rope to to hang himself and walk away laughing.

I have heard some marriages are not recognized dpending on the ceremony..is this true ? could this be one of them ? do not under estimate is knowledge he was wise enough to get here. Just make sure you do what is best and cover all ur bases. The law will eventually catch up with him. And him marrying another woman wouldn't jeopadize is greencard :wacko:

Oh I really feel for you *hugs*

It might be worth informing his "fiancee" that he is already married as well... it would be a crime to let him get away with that... If it is at all possible of course :)

The other woman knows that he is married, she has known from the beginning of their affair. I have been trying to figure out how to get his greencard revoked since he left me, I mean he has put me in such an uncomfortable position and really screwed me financially, not to mention the broken promises and the disrespect :angry:

But him having a permanent green card makes it difficult. I personally feel cheated --yes I asked for him to come, but I feel he should have been given a CR1 visa to protect me since our entire marriage was spend apart . But that's another story and I know it can't be changed now. (Boy do I wish it could.)

So yes, I do hope to let him hang himself. I just wonder exactly what kind of proof I could present to get him in trouble for bigamy? maybe I could get a PI to follow him around once he travels to his country, but what kind of proof would they need to bring me to get him in trouble?

I'd assume the fiancee probably already knows if he's going back to his country to marry her and in some countries bigamy is not odd in the least (I don't agree with bigamy, the fiancee just may not find it so shocking) - so I'd just try to get him on bigamy charges and get a divorce if I were the OP.

You need to consult a lawyer to find out how you can prove he used you to get his permanent residency, there are many attorneys who give free consultations and he/she can guide you. Also, you do not need his consent to get a divorce, you can divorce him any time you want.

I think you should let him go ahead with the marriage and if u can get or print copies of the conversations, that would be excellent for you. I read in another post that it doesn't matter if they have a 10 year green card, if u can prove fraud, it can get revoked.

Doesn't he have to get permission from his first wife before he can marry again and show that he can support both of you. Just getting technical and you can withdraw you the affidavit of support. If you can prove that he met this other lady before you and then married you, I'm sure you would have a good case. and don't forget to sue him for child support in the meantime.

Depending on the country, a copy of the marriage announcement or certificate would not be difficult to obtain. . .lots of countries make them public.

His is considering marrying someone while he is married to you, IS ENOUGH FOR MARRIAGE FRAUD. You should print out his emails as evidence and give them to the USCIS.

Of course, he does not want to divorce you since you signed an Affidavit of Support. He'll want to wait until her gets his permanent card to do anything legal with the USCIS.

Please look below....there is a post labeled "SUCCESSFULLY WITHDREW AFFIDAVIT OF SUPPORT."

Do what needs to be done NOW!!!! You married trouble.

As for the other woman in Armenia....Coming to America is great opportunity and of course she wouldn't care that he is married already.

Print your husbands emails as EVIDENCE!!!! And the other woman's reply emails as evidence!!! Get them translated if necessary.

If you read the OP's post, you'll see her husband already has a green card, and therefore it's a lot more complicated than simply withdrawing the affadavit of support. The affadavit of support can only be withdrawn prior to approval for a green card (or, I'd assume, an immigrant visa). She would have to prove fraud on her husband's part to get the green card revoked, and therefore, be let off the hook for the affadavit once/if her husband is removed.
