I need some help - I just got married here in Japan December 15. I just found out my wife is pregnant today January 4th Local time. We became very excited until I thought of the Visa Process.

Background:

I am the USC (Husband)

She is Japanese Citizen.

I just filed for the legal marriage and are going to pick up the papers as we speak so we are LEGALLY Married.

I am going to apply for the CR1 Visa after returning to the states but here is the question. That usually takes 9-12 months and if I am correct, a baby takes about 9 months! How will this effect the paperwork? How will this effect the handling of the VISA? Should I do something different??? Do I have to apply for a visa for my kid? Sorry if I sound in a panic but to be honest, I am!

Nothing will change for the visa for your wife. Except if she is pregnant when she is scheduled to have her medical. But its nothing to worry about really.

I'm assuming the child is yours. Once he/she is born, you can file for a consular report for a birth abroad and then get a US passport for the child.

1st of all Congratulation... :thumbs: somebody here will correct me if Im wrong, you dont need to apply visa for your own baby just apply for US pastport soon he/she born ..go to american Embassy there in japan then show his/her birth certificate showin that your the DADDY :thumbs: .... I dont know if in japan got DUAL citizenship..... Goodluck nothin to worry about the paperwork...HAppy for you both! :dance:

March 2005- Interview in USA EMBASSY in Philippine

April2005 - Waiting for my Police clearance from JApan

May 2005- submit the Police clearance in US EMbassy

June2005 - Waiting for my approval result

June 28 2005- Visa on hand!

July 13 2005- Arrive in USA

June -July 2007- have a notice from USCIS that may interview will be soon..

Aug 2007-- Re-schedule My interview..

sept 2007-- waiting for the new schedule for interview!

Oct.2007-- my son turn 1 year old...

Nov 2007-- I got the schedule for my interview.. so excited

Dec 17 2007- FINALLY the interview ...

Dec 21 2007.card production ordered

Dec 26 2007-Notice E-mailed welcoming the new permanent resident

Jan.2 2008- Approval notice been sent.

Jan 20 2008- Recieve the (10years) GREEN CARD on the mail! FINALLY!

I don't think Japanese citizens are allowed to have a dual citizenship. Since you're planning immigration anyways, I suppose that doesn't really matter though.

I might be wrong about the citizenship but I recall hearing it somewhere.

ur kid is automatic usc jus report it to the us embassy.for sure the embassy will request dna test for u and your kid,jus be ready for that,ived been through in that case when i report birth of my son,congratulations........

Thank-you everyone for the quick response! Very helpful - I feel more assured to know that there is no problem for the paper work. The plan is for me, the usc to return to America and work until the wife gets the visa. She will keep her Japanese citizenship and while Japan does not allow duel citizenship I believe for kids up to 18 years old they can have duel citizenship and then they must decide after that, but I am not sure. I am just the most relieved about knowning the paperwork will not be a big problem with a kid in the picture now...

We sat at the Japanese government building waiting for the marriage certificate and kept saying we couldn't believe we are going to have a kid. It is exciting but kind of scary at the same time :blink:

Congrats!

I am in the same situation... It's exciting and scary and most of all frustrating (once you start the paper work)...

I filed my papers back in October and have heard nothing. The paperwork doesn't change due to the baby, but that doesn't mean it's not a problem :(. You will have to file for the baby passport which can take up to 1 month.

One thing I would suggest is NOT to file originals (marriage certificate, birth certificate, etc) with your I-130. I did and now I'm wondering if they will get lost in the system, then it will be a real b**ch to get new ones.

My child is due in May... so it looks like the baby will be born in Japan. Which by the way can be very expensive. Most U.S. insurance companies will not cover the cost of the birth. In addition the Japanese National Health Care does NOT cover birth. The average cost ranges from $5000 to $15000 (dollars)...

If you think it's scary now, wait til your kids are 38 and 35 like mine - nasties that happen to them will mess up your life too - just when you want a break from the slings and arrows of outrageous fortune

sorry for the hint of social realism there, but enjoy this time while you can because it's the easy bit !

For anything you send to the USCIS, copies are fine unless otherwise requested. Originals are not likely to be returned.

For the interview, you will need to show originals or certified copies for some documents, but you will generally get them back after the interview.

If I was in your case.. I would apply for K3 Visa..

File the I-130 then when you get the NOA1 Apply for I-129F.. Its faster then CR1..

NVC Case Complete = January 2, 2008

Received Packet 4 here in the US (Interview Packet) = January 18, 2008

Case Left NVC Forwarded to USEM Manila = January 23, 2008

SLEC Medical = Jan 31 and Feb 1, 2008 (2 days)

USEM Manila Interview = February 20, 2008 @ 8:30am = DONE! (Status: 2 Months wait is over APPROVED)

CFO Guidance & Counseling = April 17, 2008

Visa in Hand = April 18, 2008 (Our Wedding Anniversary)

Arrival in the US and POE = April 23, 2008 JFK Intl. Airport New York City

Social Security Card = May 2, 2008

Congratulations! The newborn will be a US citizen. But you have to report the newborn's birth to the Embassy (Consular report for a birth abroad) and they will issue the baby's passport. As far as the visa process, if won't be affected. Airlines usually don't carry a passenger a pregnant woman very close to her due date. You can later notify Embassy about her situation. First, file I-130 for her, then think about all later.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview
