I have a family of 4 who just had their DV (lottery) interview last week but were all denied because they (husband & wife) added the husband's son from previous marriage to the petition after the fact (after the lady won), the son wasn't included in the initial application when she played. Nevertheless the embassy took the interview fees from this poor family ($3000+ ($755 a piece) to my knowledge). Is there any remedy to this craziness, any appeal? This might be against the rules, policy or whatsoever, some might say they broke the rule, I think refund them some of the money and just take the interview fees i.e like the $100 that they normally take for visiting interview. Or give the ones that are qualified. Just my 2 cent. Any advice will be appreciated so I can pass it on to them.

As far as visa fees are concerned they are nonrefundable. I think there is some verbage that there is no gaurantee of the visa.

Sorry I don't know more about this.

With the diversity lottery, if a husband/wife applies, and then wins. during processing, they ask the "winner" about possible additions to the visa. I don't know if this is an absolute or case by case call by the C.O., however; one associate of mine immigrated to the U.S. through the visa lottery in 2006 and brought his brother with him (they have no mother or father) as he was responsible for his little brother. I dont know if this matters, but they are from Ghana.

p.s. I will see if I can find out more information or specifics

okay this is what I found out.

14. NUMBER OF CHILDREN: Entries must include the name, date and place of birth of your spouse and all natural children, as well as all legally-adopted children and stepchildren, who are unmarried and under the age of 21 (do not include children who are already U.S. citizens or Legal Permanent Residents), even if you are no longer legally married to the child’s parent, and even if the spouse or child does not currently reside with you and/or will not immigrate with you. Note that married children and children 21 years or older are not eligible for the diversity visa. Failure to list all children who are eligible will result in disqualification of the principal applicant and refusal of all visas in the case at the time of the visa interview. See Frequently Asked Question #11.

15. SPOUSE INFORMATION - Name, Date of Birth, Gender, City/Town of Birth, Country of Birth, Photograph. Failure to list your spouse will result in disqualification of the principal applicant and refusal of all visas in the case at the time of the visa interview.

16. CHILDREN INFORMATION - Name, Date of Birth, Gender, City/Town of Birth, Country of Birth, Photograph: Include all children declared in question #14 above.

so it looks as if he forfeited his opportunity to receive the visa.

Thanks for all your replies, I think the child here is under 21, its sad case. Anyone know if mothers have to do DNA test to bring their kids to the states?

That is embassy specific, sometimes yes and sometimes no.

I don't understand the high fees of $ 3000. What exactly was the fee for ? Form filing fees or did they use a service to help them file ?

there is an extra charge for diversity visa (to make it a self funding program) so reg visa is around 300 + surchage X number of applicants.

The department of State has very specific instructions :

1) All the family members should be listed in the application (including couples seperated) + pictures of everyone

2) All application need to be run until a decision is reached (ie visa granted or denied)

In terms of remedy to get reimbursed or appealing the decision , I am afraid the reason for the visa denial looks pretty clear cut to me (forgot to include a member of the family in the initial application )

Wow this story hit home like rainfall....my mom won the Dv lottery back in 1996 and only included 3 out of her 7 kids(the form only had space for 3)after finding out she won,she hesitated to put the remaining 4 plus a step child(my dAd had twin boys from another relationship but only one survived).Long story short we were denied but with my dads valiant and undying effort he was able to squeeze his way back into the embassy...got our case reopened somehow,next thing you know a field inspector was sent out to inquire from neighbours if my mom really had 7kids and if she reAlly has a booming business..Gbosa pali approved and we all dey here happily ever after(Thank you Allah)

There is no real appeal of DV lottery decisions , Because the applicant broke the rules ( did not list all children ) the applicant is denied and therefor no one gets a visa. All fees are non refundable. While Joseph was at the embassy once there was a family ( Parents and children ) where they had sold EVERYTHING to pay for the DV visa fees ( and pre buy tickets ) and were denied because they didn't understand the education/qualifying employment clause. ( the winner wasn't a proper O list job skill ) The embassy processed the family so they "earned" the fees.

This will not be over quickly. You will not enjoy this.
